FordDozens of Ford customers in 14 states have filed a class action lawsuit against Ford Motor Co. alleging its vehicles accelerate unintentionally and suddenly without any way to stop them.

The Ford acceleration class action lawsuit, filed Thursday in West Virginia federal court, takes aim at approximately 30 Ford models from 2002 to 2010 — including the Ford Mustang, Ford F-Series pickup trucks, Mercury Cougar, Lincoln Town Car and Ford Explorer — that contain an alleged design defect that allows the electronic throttle system in the cars to take control of the accelerator from the driver. Plaintiffs note that Ford installed a brake override system in cars manufactured after 2010, but did not install this safety measure in older Ford models.

Plaintiffs say Ford deliberately hid the issue from buyers and “could have and should have prevented dangers presented by these foreseeable incidents by including a [brake-override safety feature].” As a result, customers were not only put in danger but also bought and leased vehicles that aren’t worth as much as they paid, the class action lawsuit says.

The Ford class action lawsuit is reminiscent of those filed against Toyota after the Japanese automaker recalled millions of vehicles over reports of sudden, unintended acceleration. The cases were consolidated in 2010 and have slowly made their way through the court. In February, a federal judge preliminarily approved a $1 billion class action lawsuit settlement to compensate certain Toyota, Scion and Lexus owners and lessees affected by the vehicles’ defective electronic throttle control systems.

The Ford unintended acceleration claims are the latest blow for the company, which has battled several class action lawsuits over alleged engine defects. In January, six consumers filed a class action lawsuit claiming Ford knowingly sold certain 2005-2012 vehicles, including the Ford 150 and Lincoln Navigator, with engine defects that caused performance and safety issues. One month later, U.S. consumers who purchased or leased a model year 2003-2007 Ford vehicle equipped with a diesel engine received notices of a class action settlement resolving claims the engines are defective and plagued with problems.

Plaintiffs in the Ford Unintended Acceleration Class Action Lawsuit are seeking compensation from Ford for the loss of their vehicle value. The case is Belville v. Ford Motor Co., Case No. 12-cv-06529, U.S. District Court, Southern District of West Virginia (Huntington.)

The Ford brand vehicles listed in the class action lawsuit are:

2005-2007 Five Hundred
2005-2009 Crown Victoria
2005-2010 Econoline
2007-2010 Edge

Update 2: A federal judge refused to dismiss the Ford class action lawsuit on March 31, 2014, but did trim several claims.

Still having accelerations. How can anyone sell the car that could kill someone. The worry over when this will occur is terrorizing. I wanted to give my car to my grandson. The pain and suffering of being stuck with these lemons , every day, needs to be addressed as well. Same 2006 Lincoln Town Car.

  2. Larry Gilley says:

Our 2009 MKS just suffered from this Sudden Unintended Acceleration. My wife was sitting at a red light with her foot on the brake when the car suddenly accelerated on its own and collided with the car in front of her. We are very lucky no one was hurt and there wasn’t a pedestrian in front of her.

My 2013 Ford Focus did this recently. We ended up totaling it out since the extended warranty we bought separately wouldn’t cover it and it was nearly $3000 to fix. Kinda messed up that this is still going on. Not to mention I received a speeding ticket because of the acceleration.

2006 Lincoln Town Car – I hit a fence 2yrs ago and thought I was losing my mind. The unintended acceleration has happened 6 more times in the last 4 months to both my son and I. I fear for my life, and it is our only car. Can someone contact me regarding joining the law suit and or how to fix the problem. lindaficke@outlook.com Also looking for mechanic familiar with problem, near Albany, Oregon area

I have a 2013 Mustang GT with only 42 thousand miles I bought it new and it has done it 2 times only just recently going to work on an intersection with a red light I press on the brakes and it started to accelerate, the engine was very loud, very fast I grab the shifter and push it to park and I was able to stop it. I think I will get rid of it,
So sad because I love this sterling grey mustang.

Can someone please reply and let me know how I can join this suit? I just totaled my 2006 Ford Mustang V6 Convertible on 11/20/2020. I had just pulled out of a Sam’s parking lot after getting gas and was approaching an intersection, (red light) in preparation to making a right turn. When I applied the brake to stop, the car suddenly accelerated at full throttle, I stood on the brake, smoking the tires, but the car just kept going, driving into traffic in the intersection where I impacted with another car. the police reports notes skid marks from my attempts to bring the car to a stop long before I reached the intersection and witnesses told the police officer that the car was continuing to Rev after the impact during which I was rendered unconscious. I ended up in the ER with a cuts, bruises, contusions, a fracture to a vertebrae and a badly sprained hand. Fortunately, I hit a large heavy SUV which resulted in minimal damage to it and no injuries to the driver, had it been a smaller car with more people it would have resulted in serious injury or death. The frontend of my Mustang looked like it’s been smashed by an angry giant and is totaled.

I was just doing a Google search into this problem as I am having the same acceleration issue with my 2008 Ford Escape. I was applying the brake at a stop light this afternoon and the vehicle suddenly accelerated and lurched forward….just about scared my husband and myself to death. He could hear and feel the acceleration, too. Fortunately there was no one in front of me or an accident would surely have occurred. Could someone please inform me what to do to fix this. I’m afraid to drive it now.

  9. Dallas Carlon says:

  10. RYAN says:
