Ford Engine Problem Class Action Lawsuit

FordSix consumers have filed a class action lawsuit against Ford Motor Co. claiming it knowingly sold certain vehicles – including the Ford 150 and Lincoln Navigator – with engine defects that caused performance and safety issues. All six consumers allege Ford knew about the alleged defects from 2005 to 2012 but concealed the problems to avoid covering their repair costs under warranty.


The Ford engine class action lawsuit claims Ford knew for a period of seven years that vehicles equipped with the 5.4L engine had design or manufacturing defects that caused acceleration hesitation, loss of RPM, stalling and loss of power or sudden deceleration.

As evidence that Ford knew of the alleged engine defects, plaintiffs cite in the class action lawsuit an August 2008 technical service bulletin to Ford dealers advising them on how to repair the defects. Ford chose not to alert vehicle owners and the public of the engine problems, however, the class action lawsuit says.

“Although defendant recognized in 2008 that many of its vehicles contained engine problems, it actively concealed from the public, and the owners of this class of vehicles, the need to perform certain services and/or repairs to remedy these defective and potentially life-threatening conditions,” the Ford engine class action lawsuit states.

“Concealment of these engine problems was orchestrated to minimize and/or avoid the defendant’s contractual responsibility to the plaintiff class of owners,” the class action lawsuit continues.

The Ford engine problem class action lawsuit is brought on behalf of all current owners of any 2004-2008 Ford passenger or light truck vehicle sold in the United States and equipped with a 5.4L engine and includes the original Powertrain Control Module (PCM), the Transmission Control Module (TCM), the Electronic Throttle Control (ETC) and/or the Throttle Body Assembly. The class of vehicles is limited to those delivered within 8 years and having less than 80,000 miles.

The plaintiffs are seeking out-of-pocket replacement/repair costs, diminution in value of the class vehicles attributable to the defects, damages, injunctive relief and more for alleged breach of express and implied warranty, common law fraud, negligent misrepresentation, unjust enrichment and violations of state consumer protection statutes.

The Ford Engine Problem Class Action Lawsuit case is Jason Schmidt et al. v. Ford Motor Co., Case No. 12-cv-07222, U.S. District Court of the Eastern District of Pennsylvania.

Plaintiffs are represented by Larry E. Coben, Sol H. Weiss and Julie P. Thompson of Anapol Schwartz.

 

UPDATE: On September 23, a federal judge trimmed most of the claims in the Ford Engine Defect Class Action Lawsuit, but refused to dismiss it entirely. The class action lawsuit continues. 

UPDATE 2: On August 1, 2016, judgement was entered in favor of Ford Motor Co, and the case was closed.

    I’m right there with Mike. When is there going to a class action suit against the 6.0 ltr POS (that does not stand for Power Stroke Engine)? I have a 2004 F350 that took two craps on me at 140,000 miles. I put in over $4000 and it is still a sicko.

    I just wanted to update everyone that has posted. We still have the ability to add more owners to the suit. We have many people in the same situation as I am.       I have a 2004 Ford F-150 5.4L and I have replaced all plugs, both VCT selanoids both camshaft selanoids and my truck runs good at start up. But after about 10 mins the ticking gets so bad I can’t drive it any further. It has 170,000 miles on it. Is there any options for me.

      I am in Canada and own a 2005 Lincoln Navigator. Just brought into a garage after engine was running rough. Told Cam Retard issue could be cam solinoid after told alternator needed replacing $600 but just spent $800 two weeks earlier on wire replacements and change of coil and plug on two cylinders. Ford needs to take responsiblity for this piece of crap vehicle. The side stepping boards where mounted with Aluminum brackets which have rotted away since you cant put aluminum and steel alloys together. The air suspension problems are all over the internet. It literally is a nightmare of car problems and thousands to fix,…I can see why they are hiding

    I have a 2002 and a 2006 Expedition. This past September while driving back from bringing my son to college a spark plug blew. It was the 2002 which only had 58,000 miles. We had to get the car towed. The dealer quoted between $3,000 and $4,000 for repair. We were able to bring it to a local mechanic for much cheaper. It stillcost alot between toying and repair never mind the stress. We were told it could happen again, now I worry every time I travel. After reading these posts it sounds like it is happening alot and this should not be. We should consider starting our own class action against Ford.

    i have a 05 f350 i bought new i have had nothing but problems with it even within the first month tire pull, glow plugs, injectors, radiator, airconditoning, fuel pump, heads, egr and is currently in and est repair cost for this one is 8000 my only transportation have been on foot rented a car had to tow stayed in hotels as trk broke down when out of town loss of power no start overheating how do i become apart of this lawsuite

    I have a 2005 E350 passenger van that has the same problems except it has high mileage (249K). Why is there a limit on the mileage? I know that the mileage on my vehicle is extremely high but most people drive more than 10K miles per year. Are there any other lawsuits for the rest of us to join in on?

      We have 2004 f150 truck has same ticking noise that all these trucks have…has been parked for over a year I have not had the money to fix it…it turns on but after a while starts shaking and turns off. I don’t understand how ford gets away with not recalling this. I’m very disappointed and will never buy a Ford vehicle again!!!!!

        My 2004 Ford F-150 did exactly the same thing. The noise from the cam phasers was terrible. At 160,000 miles I had the engine replaced with a long block 5.4 three valve and it has been back in the shop for 6 weeks and the mechanic still can not get it to run correctly. There has to be a serious problem with the 5.4 Ford engines and possibly their computer.

    I have a 2002 F-150 w/5.4 and ford is putting in plug inserts as we speak, all together i will have 5 grand in repairs and i only have 93K on the truck, i would like to get a class action going and some media coverage on this problem. I have already contacted my Senators to help and car magazines to spread the word. Ford started having the plug problem in 1997 and continues on the 4.6, 5.0, 5.4, and the 6.0. I want to be a part of a class action.

      We have just had this same issue in February, and Ford is not willing to help, have you tried any other recourses? Ours ended up costing us $7200.00 with only 50miles on my V10, so I am also interested in a class action

      We had the same problem with our 2002 Expedition. Contacted the State Attorney General’s office after the 2nd spark plug. All they did was contact Ford with the complaint who denied any liability. That was before 100k miles. Cost us 400.00 @ Ford dealer each time. Happened again and again, last time it blew a plug we’d already had replaced. They couldn’t fix it, had to have both heads rebuilt. Cost us thousands of dollars. The class action is only for years 2005 and up in the Expedition. We have decided to never buy Ford again.

    I had a 2008 Lincoln MKX…thats the same as a Ford Edge, correct??? At 17,000 miles the Transmission went up…all covered, but a huge inconveinence. Are Lincoln’s considered a part of this too??

    i have a 2004 expedition with just over 100000 miles but my spark plugs blew out of the engine while driving how can i join this lawsuit
