Ford Engine Problem Class Action Lawsuit

FordSix consumers have filed a class action lawsuit against Ford Motor Co. claiming it knowingly sold certain vehicles – including the Ford 150 and Lincoln Navigator – with engine defects that caused performance and safety issues. All six consumers allege Ford knew about the alleged defects from 2005 to 2012 but concealed the problems to avoid covering their repair costs under warranty.


The Ford engine class action lawsuit claims Ford knew for a period of seven years that vehicles equipped with the 5.4L engine had design or manufacturing defects that caused acceleration hesitation, loss of RPM, stalling and loss of power or sudden deceleration.

As evidence that Ford knew of the alleged engine defects, plaintiffs cite in the class action lawsuit an August 2008 technical service bulletin to Ford dealers advising them on how to repair the defects. Ford chose not to alert vehicle owners and the public of the engine problems, however, the class action lawsuit says.

“Although defendant recognized in 2008 that many of its vehicles contained engine problems, it actively concealed from the public, and the owners of this class of vehicles, the need to perform certain services and/or repairs to remedy these defective and potentially life-threatening conditions,” the Ford engine class action lawsuit states.

“Concealment of these engine problems was orchestrated to minimize and/or avoid the defendant’s contractual responsibility to the plaintiff class of owners,” the class action lawsuit continues.

The Ford engine problem class action lawsuit is brought on behalf of all current owners of any 2004-2008 Ford passenger or light truck vehicle sold in the United States and equipped with a 5.4L engine and includes the original Powertrain Control Module (PCM), the Transmission Control Module (TCM), the Electronic Throttle Control (ETC) and/or the Throttle Body Assembly. The class of vehicles is limited to those delivered within 8 years and having less than 80,000 miles.

The plaintiffs are seeking out-of-pocket replacement/repair costs, diminution in value of the class vehicles attributable to the defects, damages, injunctive relief and more for alleged breach of express and implied warranty, common law fraud, negligent misrepresentation, unjust enrichment and violations of state consumer protection statutes.

The Ford Engine Problem Class Action Lawsuit case is Jason Schmidt et al. v. Ford Motor Co., Case No. 12-cv-07222, U.S. District Court of the Eastern District of Pennsylvania.

Plaintiffs are represented by Larry E. Coben, Sol H. Weiss and Julie P. Thompson of Anapol Schwartz.

 

UPDATE: On September 23, a federal judge trimmed most of the claims in the Ford Engine Defect Class Action Lawsuit, but refused to dismiss it entirely. The class action lawsuit continues. 

UPDATE 2: On August 1, 2016, judgement was entered in favor of Ford Motor Co, and the case was closed.

    2005 F350 Diesel Great Truck right? Wrong. Spent 40,000 + for a truck and historically have spent 23,600… Unbelievable…(copies of all repairs done at Ford Dealership ready for submitting for some return of our money) Fuel Injectors (Multiple) Turbo out, on and on and on… Getting ready to sale or trade. Can’t wait to see if the Federal Judge sides with us American Citizens who are getting screwed from “Ford” or it’s decision to have a third party produce the engine for FORD… However if that was Ford’s bad decision then they should definetly stand by that bad decision.

    I have a 2005 f250 fx4 with the 5.4l triton v8. a month ago i took it to the dealer for plugs at 105329 miles and a week later it sounded like a diesel and quit running. back to the dealer i go and after a couple of days i was told i needed a new motor for $7000.00. i was never told any plugs broke but when they dropped the oil pan parts of the piston were in the oil pan.LETS GET OUR MONEY BACK FOR THE PROBLEMS FORD HAS CAUSED US

      I have a F-150, bought it brand new with a 8 miles on it. At 100k as my warrenty instructed me, I took it to the dealer to get a tune-up. The dealer in Virginia Beach told me it was $300.00, I said, fine. He then pulls out two spark plugs and tells me there is a defect with the plugs. They tend to break at the threads. The first one that breaks would cost me 100.00, and every one after that would cost 50.00. I am taking this vehicle to the dealer where I bought it, to machanics trained in working on Fords, to replace plugs that were sold with this truck. Why am I responsible for paying Ford for their defective plugs? I try to get these plugs out on my own with their special tool. I break 5 of the eight plugs. Now I have to go to a Ford dealership. I have my truck towed and it sits in the same parking place for a week. They contact me and tell me the head has to come off for them to extract the #6 and 8 plugs. My truck has not moved. We put it in neutral and once at the dealership, we disconnect the battery (6 plugs were out and two were broken). I visited the dealership 4 times within that week and my truck was always in the same parking place, 3 rows from the shop, far left space. Also the battery was still disconnected. They know not to start the vehicle, why is the battery still disconnected if you are trying to pull these plugs? You have to connect the battery to push into the shop. I would feel so. I gave up on Ford and asked for my keys. The mechanic said that he was sorry he couldn’t get the plugs out and it would cost me 2600.00 to take the head off. He also said it was obvious what needed to done just by looking at the plugs. I wonder if they even attempted to do the job. Finally, I had my truck towed to another mechanic who said they could get them out for 300.00. That was last night. They started working on my truck this morning. At 12:15 they called and told me my truck was ready for me pick it up. 3 hours!!! 2300.00 less than the Ford Dealership. I shouldn’t have to pay a dime, but don’t shaft me. You sell me your problem, and then screw me for buying it. I love my truck, but I will never buy another Ford. Ford should make this right, but I doubt they will.

    I bought a used f150 on 3/20/2013 form the dealership with 89k on the motor. I did not purchase the warranty i did not think i would need it. Now i have the the same knocking noise and need a new motor. Do i have a claim in this. SING ME UP!

    I brought my car explorer v8 2006 to be serviced at a ford dealership queens ny back in feb, 2013oil filter change,multi point inspection. They repaired and gave my a bill for 2000.00. April 24 my engine seized because of lack of oil- just to months prior from when I got the ok to pick up my car and 2 thousand later. Would this be part of this lawsuit or any other in regards to ford service department mishandling of repairs? Thanks for your time.

    I have a 2005 Ford Mustang that had throttle sensor problems and was fixed twice! Now the engine is blown. Dealer said to contact FORD and FORD wont do anything about it. I only have like 65000 miles on my vehicle. Please tell me who to contact in regards to the this lawsuit.

      i have a 2004 ford it give me all kind of problems first starter then something start to mess with battery i replace it and then the abs system like came on still on until this day go off sometime then right back on all the water and antifreeze seek out the resivoir tank have to replace it it just to much to be bother with

        I have a 2006 ford f150 with 5.4 triton engine ,,,,I took to dealer and they said nothing they can do I’m 62 an disable on small income an cant afford to trade.. my wife had massive stroke on top of all that ,,,I need spark plugs I believe an mass air flow an all sencors check ,,,,they said 1250.00 just to change [plugs I cant afford that ,,,please someone help ne

    I had a Ford Taurus that the accelerator pedal stuck and I hit a car going over 70 mph and killed their dog. My car was totaled, and the person tried to sue me for personal injuries.
    A horribly scary experience having a car speed up thru a stop sign into oncoming traffic with my son in the car.
    I need to join this class action as i’m still haunted today from this.

    I purchase my F150 in 2004 and at 30,000 miles the knocking noise started… Just over 100,000 miles my engine blew up costing me right at $8,000.00 to replace the engine. How do I get on this lawsuit???

    I have always purchase American cars specially ford and now I realized the f150 5.4 2005 I got its the worse purchased ever. I already spend over 7000 dollars on still the same problem with the motor.

    Anyone involved with Jason Schmidt et al v FMC should review Galo Coba v FMC submitted with the USDC New Jersey Judge Dickerson R. Debevoise . Case 2:33-av-00001 document 14385 submitted 3-14-12. Also support your attorney with a copy of your OASIS Report ,warranty claims, and maintenence records.
