Ford Engine Problem Class Action Lawsuit

FordSix consumers have filed a class action lawsuit against Ford Motor Co. claiming it knowingly sold certain vehicles – including the Ford 150 and Lincoln Navigator – with engine defects that caused performance and safety issues. All six consumers allege Ford knew about the alleged defects from 2005 to 2012 but concealed the problems to avoid covering their repair costs under warranty.


The Ford engine class action lawsuit claims Ford knew for a period of seven years that vehicles equipped with the 5.4L engine had design or manufacturing defects that caused acceleration hesitation, loss of RPM, stalling and loss of power or sudden deceleration.

As evidence that Ford knew of the alleged engine defects, plaintiffs cite in the class action lawsuit an August 2008 technical service bulletin to Ford dealers advising them on how to repair the defects. Ford chose not to alert vehicle owners and the public of the engine problems, however, the class action lawsuit says.

“Although defendant recognized in 2008 that many of its vehicles contained engine problems, it actively concealed from the public, and the owners of this class of vehicles, the need to perform certain services and/or repairs to remedy these defective and potentially life-threatening conditions,” the Ford engine class action lawsuit states.

“Concealment of these engine problems was orchestrated to minimize and/or avoid the defendant’s contractual responsibility to the plaintiff class of owners,” the class action lawsuit continues.

The Ford engine problem class action lawsuit is brought on behalf of all current owners of any 2004-2008 Ford passenger or light truck vehicle sold in the United States and equipped with a 5.4L engine and includes the original Powertrain Control Module (PCM), the Transmission Control Module (TCM), the Electronic Throttle Control (ETC) and/or the Throttle Body Assembly. The class of vehicles is limited to those delivered within 8 years and having less than 80,000 miles.

The plaintiffs are seeking out-of-pocket replacement/repair costs, diminution in value of the class vehicles attributable to the defects, damages, injunctive relief and more for alleged breach of express and implied warranty, common law fraud, negligent misrepresentation, unjust enrichment and violations of state consumer protection statutes.

The Ford Engine Problem Class Action Lawsuit case is Jason Schmidt et al. v. Ford Motor Co., Case No. 12-cv-07222, U.S. District Court of the Eastern District of Pennsylvania.

Plaintiffs are represented by Larry E. Coben, Sol H. Weiss and Julie P. Thompson of Anapol Schwartz.

 

UPDATE: On September 23, a federal judge trimmed most of the claims in the Ford Engine Defect Class Action Lawsuit, but refused to dismiss it entirely. The class action lawsuit continues. 

UPDATE 2: On August 1, 2016, judgement was entered in favor of Ford Motor Co, and the case was closed.

    I have a 2004 Ford Focus and have always had engine problems..when my car dies all of a sudden everything locks up! Steering wheel,brakes,can’t put it in gear! It just rolls where ever and I can’t stop or steer or anything! It’s like a death trap! Have taken it to mechanics many times and they can’t find the problem. Poor acceleration and then it shoots off..Why wasn’t I notified about this??

    Purchased my forf f150 used from hiller ford and nothing was said about the problem. It had 51,000 mi. on it and now I learned about the problem. I am very upset . Why werte they not instructed to tell of the problem / 2007 F150 5.4

    I have a 2006 F-150 5.4 Engine purchased new from a dealer that has had problems from day 4 of owning, I have had new Spark Plugs, Coil Packs installed before I had 20k miles on it. All problems that I have had are poor acceleration, hesitation, loss of RPM, stalling and loss of power or sudden deceleration and poor fuel economy Also placed catalytic converter, Fuel sending unit, more coil packs transmission repaired and now it is the rear-end having trouble caused from engine jerking during towing and regular driving has ovaled the ring/pig pin. What Can I do? I just found out about the suit this week!

    2005 F150 Lariat 4×4 w 96K that is making this awful noise..sounds like lifters….also trans went at 89K ….the least amount of miles on a ford trans for me since my first Ford truck, my 1984 F250. This truck is not worked and gets regular service…..I am very disappointed with the expensive vehicle.

    I have a 2008 F150 with the 5.4. Is there any help out there for fixing these yet. My engine is shot and I don’t have five grand to spend on another engine that will do the same. Any help would be great.

    I have 05 f150 crew cab had and still have same problem. Can’t sell it with this problem since no one will buy it knowing the problems . How do I get in on this lawsuit ?
