EA Football Video Game Class Action Settlement Checks On the Way

UPDATE: Payments went out to Class Members in late October 2013. Congratulations to our Top Class Actions readers who submitted a valid claim and got PAID!

 

A federal appeals court on Friday dismissed an appeal of the EA football video game settlement that was delaying payouts of the $27 million class action lawsuit settlement. Settlement checks will be distributed soon to Class Members who filed a valid Claim Form.

The EA football video game settlement was approved by the Court on May 30, 2013, but an appeal was filed on June 28. The Class Member who filed the appeal, Aaron Miller, had objected to the legal fees being paid out of the settlement fund, which amounted to $7.29 million — or 27 percent of the total fund. His objection was dismissed since the court’s guidelines stipulate that the fees should comprise no more than 30 percent of the fund.

Miller decided to appeal the dismissal of his objection to the federal Ninth Circuit Court of Appeals. On August 16, the appeal was dismissed.


The class action settlement will resolve claims that EA violated antitrust and consumer protection lawsuits by holding exclusive license agreements with the NFL, NCAA and AFL to market branded football video games. The alleged deal drove out competitors and enabled EA to price-gouge consumers, including by charging 70 percent more for “Madden NFL,” according to the 2008 class action lawsuit.

Class Members who submitted a valid Claim Form by the May 15, 2013 deadline can expect to see checks in the mail soon. Checks will range from $5.85 to $162.96, depending on which game(s) they purchased.

    If you filed a claim for the Ab Circle Pro then you might not get a payout. The FCC was involved in this case and if you filed a claim in any previous FCC involved cases they are going to deny your claim. I received this information straight from a representative of the FCC.

    Any idea when the checks will go out. I have a problem. I put in for this class action lawsuit at my home address and my so whom I bought these games for also put me in this suit. So I’m afraid I double dipped. Any suggestions? Should I call the claims administrator? Thanks

    Its about time. Its crazy how “1 person” was the cause of everybody’s payments being delayed. Im glad to hear they dismissed it. Now Im waiting on Ab Circle Pro to stop bs’ing and get us our money. Any updates on the Ab Circle Pro settlement checks?
