Defective Remington 597 17 HMR Semiautomatic Rifle Class Action Lawsuit

Remington Do you own a Remington 597 17 HMR semiautomatic rifle? You may want to be careful which ammunition you use. A federal class action lawsuit claims the rifle explodes if used with Cascade Cartridge/CCI Ammunition’s ammo, and that Remington issued an inadequate recall notice.

The Remington class action lawsuit claims Remington sold tens of thousands of defective Remington 597 semiautomatic rifles and possibly millions of the 17 HMR ammunition sold under its private label agreement with Co-Defendant CCI Ammunition.

In August 2009, Remington made its first public statements acknowledging that its Remington 597 HMR semiautomatic rifles may explode while using 17 HMR ammunition and warned consumers to discontinue use of both products immediately. However, Remington’s efforts to notify owners and users of the 597 was limited to a Safety Warning and Recall Notice posted on its website – a hugely inadequate recall notice that left many consumers in the dark about the danger of using the 597, the lawsuit says.

The defective Remington 597 class action lawsuit also challenges the offer made in conjunction with the recall, which the suit claims is equally inadequate: a $200 or $250 coupon for the purchase of a replacement Remington firearm and a $10 coupon for a box of 50 rounds of Remington 17 HMR ammunition.

“The coupon for purchase of a firearm was well below the purchase price paid by [Class Members] for the Model 597 17 HMR semiautomatic rifle and required [consumers] to purchase a new firearm in order to redeem the coupon,” the Remington 597 class action lawsuit states. Not only that, but the “coupon for purchase of ammunition was well below the purchase price paid” for the 17 HMR ammunition, and also required consumers to purchase new ammunition in order to redeem the coupon.

Furthermore, those who purchased 17 HMR ammunition manufactured by CCI but labeled under a brand other than Remington, such as Federal, were offered no compensation for the ammunition they purchased to use in the rifle.

As a result of Remington and CCI’s negligent design, manufacture and marketing, as well as unfair and deceptive acts regarding the Remington Model 597 17 HMR semiautomatic rifle and Remington 17 HMR ammunition, consumers received “defective and unreasonably dangerous products for which they substantially overpaid because the rifle and ammunition were useless,” the class action lawsuit states.

The Remington 597 17 HMR class action lawsuit is brought on behalf of a proposed class of all U.S. residents who owned a Remington Model 597 17 HMR semiautomatic rifle or any type of 17 HMR ammunition manufactured by CCI Ammunition that was purchased for use in that firearm.

It is seeking actual damages (including multiple damages) or statutory damages, whichever is greater. It is also asking the Court to force Remington to re-issue the recall notice in a “commercially viable manner,” including direct communications with known owners of the rifle and publication in widely read media.

    I bought the Remington 597 .17HMR…How do I join the lawsuit? I too had a bullet blow up out of the side & blew out the clip…. Have not shot it since!!!

    I purchased a Remington 597 chambered in .17HMR in 2003. I have fired less than 200 rounds through it with no problem, most of the rounds were manufactured by Hornady and were fired this year. However, I just learned of this issue today while looking up the 597 on an online auction site because I was considering selling it. Why didn’t Remington notify owners of these rifles about the potential issues? Although thankfully I have not had any problems with the rifle to date, I cannot with any level of confidence take it to the range and fire it again. Conversely, returning it to Remington for a pittance of a credit voucher does not seem to be a viable option either. Please keep me informed of any remedy that would assist in recovering my purchase price for this defective firearm.

    I bought my Remington 597 17hmr in 2010 today I attended to shoot a few rounds threw it and first shot exploded in my face. Rang my ears blew the clip in to four pieces blew the bolt out and Jammed the receiver open.I called Remington arm were I got to talk to a man called his self JB.all he would say to me after hearing my complaint was we will rebore the barrel to a 22 mag or give you a 200 dollar coupon. And the gun is not sup posed to shoot 17 HMR.ammo in a auto loader.I own two 22LR.one seventeen HMR.and one 22 mag all in the Remington 597 mod……..from this day on I will discriminate against Remington firearms in any open forums Internet Facebook gun shows and any we’re anybody will listen. Remington firearms is chicken shit.Rebore that Remington.

    my wife bought a semi automatic 17 HMR she shot several hundred rounds through it with no problems she loved the riffle till recently it blowed up to mags back to back now we find out about the recall the $200 offered is a joke she paid a little over 400 for the gun all I see is questions and no answers I would like to know some answers on how to settle this

      SHi I just seen this recall and your story we haven’t shot the rifle in years my wife like s this rifle last week at camp on her last round I was standing behind her I seen powder cloud and my wife wiping her face I knew something was wrong she was ok but the same thing mag blew apart and bolt lever blew off I wondered if you guys had gotten any action from Remington. Thanks for sharing

    yea had the 597 17hmr blow up on my 8 year old this past weekend. I’ve owned this rifle for years and now after it blows up I find out there’s a problem with the gun Remington should of sent the notice to the end user especially since there blowing up. I only use hornaday ammo. how do you get in on this law suit.
