Biden Vaccine Mandate Class Action Lawsuit Overview:  

  • Who: A group of federal employees lodged a class action lawsuit against President Biden and the Secretary of the Department of Defense Thursday.  
  • Why: The group says that the recently announced Biden vaccine mandate violates the US Constitution and their religious freedom.  
  • Where: The lawsuit is pending in federal court in Washington DC and the plaintiffs want to represent federal workers nationwide.  

The recently announced Biden vaccine mandate has drawn a class action lawsuit filed by federal workers, including service members and contractors, who say the requirements under the Executive Order violate the US Constitution and their religious freedom. 

Nearly a dozen workers lodged the lawsuit, naming President Biden and Defense Secretary Lloyd Austin as defendants. They want to represent Classes of religious or disabled service members, federal employees, and federal contractors who they say will face “adverse employment status,” be denied necessary accommodations, or be unable to obtain employment with the government due to the requirements of the vaccine mandate.  

Biden Vaccine Mandate Issued

Earlier this month, President Biden announced that federal workers, including contractors, would be required to get a COVID-19 vaccination. The US Department of Defense has also issued a vaccine mandate for service members.  

“We’ve been patient. But our patience is wearing thin, and your refusal has cost all of us,” Biden said at the time.  

The Biden vaccine mandate comes after the Food and Drug Administration (FDA) granted official approval of the Pfizer-BioNTech COVID-19 vaccine in August. Three vaccination options had been granted emergency use authorization by the agency in earlier months; however, after an initial surge, vaccination rates fell off.  

The federal workers who filed the class action lawsuit take issue with the requirements of the Biden vaccine mandate, alleging that the Executive Order fails to properly accommodate religious or medical reasons for not wanting the shot.  

Workers Fight for Religious, Medical Exemptions to Biden Vaccine Mandate 

The plaintiffs say that the vaccine mandate runs counter to laws protecting religious freedom in the United States.  

“If a Christian comes to an informed and sure judgment in conscience that he or she should not receive a vaccine, then the Christian faith requires that the person follow this certain judgment of conscience and refuse the vaccine,” states the lawsuit.  

The federal workers claim that the Biden vaccine mandate fails to take “natural immunity” gained after infection with the coronavirus into consideration, arguing that such immunity is interchangeable with the COVID-19 vaccination — a claim that has been debunked by the Centers for Disease Control which reported that unvaccinated individuals are more than twice as likely to be reinfected with COVID-19 than their fully vaccinated counterparts, according to Law360.  

The workers want a court order stopping the enforcement of the Biden vaccine mandate, as well as others. They join other military members and first responders in Hawaii who have filed class action lawsuits fighting various COVID-19 vaccination mandates in recent months.

    19 years in the Air Force and I am still waiting on my first request for Religious Accommodation for all vaccinations. I say first, because everyone knows this whole process is just for show. To date (11FEB2022) I don’t believe a single Air Force RA has been approved for vaccinations. It’s a gross abuse of power and a perversion of ideology.

    Lost my job today due to this covid vaccination. I have never had a write up and have got many awards for work. In one swoop out the door. Federal workers are losing jobs and shops are at minimum. This is when error happen and planes have issue! No reason for this mandate! It doesn’t work, it doesn’t stop anything!

    “Secure In your person” is promised by the Constitution (4th Ammendment). If the government can take away your power of choice, we are no longer ‘secure in your person’!

      Looking for an attorney for a pre-K school teacher. Has medical exemption. looking to join or initiate law suit that will block the federal vaccine mandate in Va. and/ or remaining 24 states not covered by the Louisiana ruling. Will be pulled from my position on Feb 28 if not vaccinated.

    HI am a Federal Contractor that was told to get the jab or be released. I have been on the same project for 12 years and have proprietary skills that make me valuable to the Army but my skills may not transfer to Commercial employers. I have had Covid and have Natural Immunity but was forced to get vaccinated anyways. No religious immunity would be excepted. This is a violation of our rights. Please call and or email me for details and add me to this lawsuit.

    I have been taking care of patients throughout the pandemic and then told I have to get a vaccine or be terminated. How cruel is that!!! I am good enough to help make you money,but not good enough to keep with an exemption. First, you give me an exemption and then take it away and terminate me!!

    I have been employed as a federal employee for over 16 years in an overseas position. I along with others who have refused to get the shot had to fill out exemptions for medical or religious reasons. I feel that this is total overreach by our government. I don’t know when I will get the notice that I will be let go, I just want to be prepared to file suit. How can I join this class action lawsuit?

    How can I join this class action. I have lost my job and am being refused other jobs because I will not abide to an unconstitutional order. I’ve worked in a hospital and never got sick. My proof is my body and my good health that COVID is the yearly flu with 99.98% survival rate which is proven and yet ignored to enforce this lethal injection.
