First Responder Vaccine Mandate Class Action Lawsuit Overview:

  • Who: First responders have filed a class action lawsuit against government officials over vaccine mandates
  • What: The group of more than 2,000 first responders allege that the requirements violate their civil rights
  • Where: The lawsuit was filed in Hawaii

A group of 800 first responders in Honolulu and Maui have joined 1,200 others in a class action lawsuit filed against the government, alleging that COVID-19 vaccine requirements violate their civil rights.

The class action was first filed in August by a dozen plaintiffs that include firefighters, police officers, and other first responders. The group says that it wants to stop Hawaii Governor David Ige, Honolulu Mayor Rick Blangiardi, Maui Mayor Michael Victorino, and United States Secretary of Health and Human Services Xavier Becerra, among others, from enforcing a recently announced vaccine or testing mandate.

Governor Ige issued a statement in August that all state and county workers would need to get the COVID-19 vaccine or submit to weekly testing beginning on Aug 16, and that refusal to do so could be grounds for termination.

The first responders are suing under The Civil Rights Act of 1871, which allows people to sue the government for violations of civil rights. They’re alleging the defendants deprived them of their constitutional rights to due process in violation of the First, Fourth, Fifth, and Fourteenth Amendments of the United States Constitution with a vaccine requirement that was announced last week.

Lawyers representing the first responders told KITV4 that they had received “thousands” of requests from private sector workers and students to open up other class action lawsuits.

What are your thoughts on a COVID-19 vaccine requirement for first responders or other workers? Let us know in the comments!

The first responders are represented by Shawn A. Luiz, Michael Jay Green of Michael Jay Green & Associates, Inc., and Kristin Coccaro, Esq. of Empire Law, LLLC.

The Hawaii Vaccine Requirement Class Action Lawsuit is Pelekai v. State of Hawaii, Case No. 1:21-cv-00343-DKW-RT, in the U.S. District Court for the District of Hawaii.

I hope they succeed in this lawsuit. The freedoms of all people are being taken away & to take away the unions bargaining rights is a very alarming move on the part of the government. I am in a union & count on my collective bargaining rights being protected. My heart goes out to all affected by this mandate.

No one is forced to work in a position they do not want. If the job requirements of that position are too much for one, leave it. There are others who want to work. If someone does not want to to the job as required by their employer, that is grounds for dismissal. Everyone has to meet a threshold of performance, no matter where they work. It’s fine if a job isn’t a good fit for one and one always has the freedom to leave a position that doesn’t meet their so-called values. Anyone in a position that requires close contact with the public or anyone in service to the public should be expected to protect the public by not being a host to a deadly disease that infects 7 for every one person who ends up with the Delta variant. I have no desire to be exposed to that infectious disease and since taxpayer funds are used to pay these people, they should be meeting the expectations of the public who pays them to make certain they do everything possible to protect those they serve. If they cannot, they aren’t a good fit for public service and should find something more appropriate to them in the private sector, where I’m sure there are so many good jobs for the willfully ignorant.

    1. Lani says:

      Wow “Willfully Ignorant “(Jennifer)
What do you say when someone is vaccinated wheres a mask social distances and carries the pass saying “I’m vaccinated “ I can do and go anywhere. Hmmmm! All of a sudden this vaccinated person realizes has symptoms of can’t smell his coffee then fever. Gets tested and is POSITIVE! Guess what NO ONE took his pass away . He technically still can go anywhere he wants. No one has contacted him or followed up with him. All we here is it’s the UNVACCINATED causing all the problems. Why is no one reporting that or looking at that?
Why is it that you get vaccinated but die WITHIN the 14 days then you died from COVID not from the vaccination and You died as an unvaccinated person.
Why do we have to sign off when we get vaccinated even now that it’s FDA approved?
Why is it that the SARS vaccine was taken off the market when 55 people died but with this COVID vaccine 6000 have died and no one has taken it off the market?
Why are we only talking about unvaccinated when even the vaccinated can spread the virus?
Now there talking about a booster shot and then you have to take pills with another shot.Where does it end ? It’s not gonna end because there’s a profit to be made. Why is it there have been no deaths from flu virus ?because the hospitals get money when it’s COVID related, so now it’s listed as such.
These responders put there life on the line every day when they respond to any situation and they made that decision. They should be able to make the same decision on whether or not to take the vaccine and you nor I have a right to take that away from them or anyone in the work force if they choose for or against being vaccinated. What happened to the HEPA law?

      1. Tracey says:

        100% agree, Lani!!

      2. Rina Andrade says:

Totally agree with you Lani!! Also, Jennifer uses the word “FREEDOM” and yet at the same time not really understanding the real meaning of it. :-(

        1. Dan says:

Well said Lani. There is much more at stake here than people realize. Our freedom of choice and free will are being taken away over time and if we don’t stand up for them we’ll become a socialist country, on the way to Marxism. I hope the class action lawsuit is successful.

      3. Harriet says:

Lani, the FDA didn’t approve the vaccine. Stories were not true. Workers from Pfizer stated such. There are so many lies out there, who can be trusted? I’m even afraid of the flu shot now.

    2. Harriet says:

You need to do some studying Jennifer. You really don’t know why people are protesting these vaccines. They are poison to the body. Find a place to get the real info on this deadly vaccine. It’s also becoming clear that the vaccinated people are able to transmit this China made bio war. You must study other materials besides Fauci, CDC and the others that are lying to everyone. Stop the ignorance! Study all you can get your hands on. Don’t listen to just a few, find out for yourself.

    3. Tammie says:

You my friend are the ignorant one! Do your homework you have been lied to many times about covid-19 & the vaccine which is not even a vaccine!
