Biden Vaccine Mandate Class Action Lawsuit Overview:  

  • Who: A group of federal employees lodged a class action lawsuit against President Biden and the Secretary of the Department of Defense Thursday.  
  • Why: The group says that the recently announced Biden vaccine mandate violates the US Constitution and their religious freedom.  
  • Where: The lawsuit is pending in federal court in Washington DC and the plaintiffs want to represent federal workers nationwide.  

The recently announced Biden vaccine mandate has drawn a class action lawsuit filed by federal workers, including service members and contractors, who say the requirements under the Executive Order violate the US Constitution and their religious freedom. 

Nearly a dozen workers lodged the lawsuit, naming President Biden and Defense Secretary Lloyd Austin as defendants. They want to represent Classes of religious or disabled service members, federal employees, and federal contractors who they say will face “adverse employment status,” be denied necessary accommodations, or be unable to obtain employment with the government due to the requirements of the vaccine mandate.  

Biden Vaccine Mandate Issued

Earlier this month, President Biden announced that federal workers, including contractors, would be required to get a COVID-19 vaccination. The US Department of Defense has also issued a vaccine mandate for service members.  

“We’ve been patient. But our patience is wearing thin, and your refusal has cost all of us,” Biden said at the time.  

The Biden vaccine mandate comes after the Food and Drug Administration (FDA) granted official approval of the Pfizer-BioNTech COVID-19 vaccine in August. Three vaccination options had been granted emergency use authorization by the agency in earlier months; however, after an initial surge, vaccination rates fell off.  

The federal workers who filed the class action lawsuit take issue with the requirements of the Biden vaccine mandate, alleging that the Executive Order fails to properly accommodate religious or medical reasons for not wanting the shot.  

Workers Fight for Religious, Medical Exemptions to Biden Vaccine Mandate 

The plaintiffs say that the vaccine mandate runs counter to laws protecting religious freedom in the United States.  

“If a Christian comes to an informed and sure judgment in conscience that he or she should not receive a vaccine, then the Christian faith requires that the person follow this certain judgment of conscience and refuse the vaccine,” states the lawsuit.  

The federal workers claim that the Biden vaccine mandate fails to take “natural immunity” gained after infection with the coronavirus into consideration, arguing that such immunity is interchangeable with the COVID-19 vaccination — a claim that has been debunked by the Centers for Disease Control which reported that unvaccinated individuals are more than twice as likely to be reinfected with COVID-19 than their fully vaccinated counterparts, according to Law360.  

The workers want a court order stopping the enforcement of the Biden vaccine mandate, as well as others. They join other military members and first responders in Hawaii who have filed class action lawsuits fighting various COVID-19 vaccination mandates in recent months.

    Can I join this lawsuit? I work for a nationwide telephone company who has notified us that they will be enforcing this mandate. Currently, I am attending college to further my career with in my company due to the tuition assistance that is offered here. I am looking at loosing my career as well as my plans for getting a Bachelors degree. As a 39 year old mother of two I do not want to loose the opportunity to provide financial stability for my family due to denying a vaccine.

    1. Violation of The Declaration of Independence Right To Life, Liberty and Pursuit of Happiness.
    A. For taking away our Charters, abolishing our most valuable Laws and altering
    fundamentally the Forms of our Governments.
    B. For suspending our own State Legislatures, and declaring themselves invested
    with power to legislate for us in all cases whatsoever.
    C. Abdicated Government here, by declaring us out of his Protection and waging War against us.

    Violation of the 4th Amendment
    The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

    Violation of the 10th Amendment
    The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.

    Violation of the 14th Amendment
    Section 1.
    All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

    Also, with Legal Standing the additional mentioned items.

    Discrimination
    The Executive Order Says:
    Section 1. Policy. It is the policy of my Administration to halt the spread of coronavirus disease 2019 (COVID-19), including the B.1.617.2 (Delta) variant, by relying on the best available data and science-based public health measures. The Delta variant, currently the predominant variant of the virus in the United States, is highly contagious and has led to a rapid rise in cases and hospitalizations.
    If this were a true statement, it would apply to anyone entering the US either legally or legally. However, it is not enforced for any illegals entering the county. And by this, this Executive Order discriminates against Law Abiding US Citizens by the unconstitutional overreach of this president and administration.

    Violation of The Americans Wirth Disabilities Act & HIPAA
    I had SARS COVID-19 in March 2021. I still have very high antibodies that were checked by medical provider in October 2021. My medical provider says that if I will have major organ damage if I take the mandatory vaccine with the high level of antibodies.

    Medical Misinformation
    Vaccine are developed to help the human body develop antibodies to fight a specific disease. All viruses that affect humans will result in antibody formation.

    Example: Hepatitis A Virus and Hepatitis B Virus Vaccinations.
    The antibody titer is a test that detects the presence and measures the amount of antibodies within a person’s blood. The amount and diversity of antibodies correlates to the strength of the body’s immune response.

    When these series of the above Hepatitis Vaccinations are given, Titer Tests are a part of the process that determines the antibody level in the individual.

    The requirement of the COVID-19 goes against medical protocol in that it does not include the Titer/Antibody Test at any point in the process. In fact, the Titer/Antibody Test be administered first to determine if the individual needs the vaccine. By requiring a vaccine mandate without any such medical validation is malpractice at this highest level.

    Recourse Against Unconstitutional Overreach
    By using OSHA to Enforcement of employers to comply with the Executive Order is nothing less than blackmail, extortion and coercion against legal United States Citizens. It is unconstitutional for the following reasons.
    1. OSHA was not created to enforce this type of public health issue or any Executive Order. It has a system of whereby standards are developed using a proven method to address workplace issues only. This Executive Order unconstitutionally overreaches to use OSHA in this capacity.
    2. By using this overreach, the Executive Order takes away the individuals Constitutionally Guaranteed Redress against such governmental overreach.

    Last Factual Challenge To The Executive Order
    When people disagree with this president and administration, they are branded as racist and attacked by president and administration for voicing their factually based concerns about a medical issue that should be between an citizen and their medical provider.

    They are attacked, fired from their jobs and make into criminals for exercising their constitutional rights even when they have natural immunity.

    This Executive Order is nothing more than a totalitarian overreach by the president and administration to force their will on the American Public.

    I have worked on my job for 14 years I’m 60ty years old with little time left to retirement a year ago I was hero today I’m a 0 told if I don’t have the shot by Nov 24 then I’m faced with leave without pay and possible termination,I don’t believe anyone has the right to tell me what to do with my body this should be my choice it just a violation my civil rights I believe my company is federal funded can I take part in this suit

    I too would like to join this class action lawsuit! I am a DoD employee and have never been sick with Covid during this “pandemic” and I simply do NOT want this vaccination but I am being forced to get it or lose my job!

    My employer has contracts with the federal government and therefore is requiring all employees to get vaccine by December 8th or be terminated. If an exemption is granted, it gives you 30 days to be “educated ” and change your mind. What can I do?

    I am a service connected Disabled Veteran, and have been a DoD contractor for almost 30 years, the last 20 with the same company. I was told I would be terminated on December 8th if I refuse to get the shot. I submitted both religious and medical disability exemption requests but have yet to hear back from the HR department regarding approval/disapproval. I will never take the vaccine, regardless of employment impact. How do I get included on this class action suit? I live and work in the Hampton Roads area of southeastern Virginia.

    I have worked at letterkenny Army Depot in chambersburg pa for 14 years under multiple contractors, the latest being Bowhead. It is my understanding I have until Dec.8 to get vaccinated. I feel this is very unconstitutional to be forced into doing or be FIRED. We are also not able to get unemployment for the refusal of the vaccination in this great state!Someone has got to do something about this unlawful action!

    My husband works for Standard Aero Maryville TN, he has till December 8th to be vaccinated or he will lose his job of 32 years. He had planned to work several more years. He does not feel this vaccine is right for him with his many health issues, he has seen several co workers with similar health issues physically decline as a result of taking the vaccine. This vaccine should not be a condition if employment! Our government does not have the right to force anyone to take it.

    20 Navy retiree working as a GS employee of 8yrs and I submitted a Religious exemption and there have been more questions we’ve had to answer in MilConnect. This entire ordeal has been entirely over intrusive because these Religious exemption request given by the Federal Gov ask personal Religious information and require we explain and relinquish more personal medical information about ourselves. I feel like this is a modern day witch hunt and we’ve all been required to give up HIPAA information on ourselves under duress.
    My son is a government contractor going through the same obscene scrutiny. How can we join this class action lawsuit?
