Vivid Seats Class Action Settlement Overview:

  • Who: A federal judge gave final approval of a $7.5 million class action settlement between Vivid Seats LLC and its customers.
  • Why: Ticket buyers claimed Vivid Seats changed its event cancelation refund policies following the onset of the COVID-19 pandemic.
  • Where: The class action lawsuit was filed in Illinois federal court.

The $7.5 million Vivid Seats class action settlement between an events company and ticket buyers who claimed it changed its refund policy for canceled events following the onset of COVID-19 was given final approval by a federal judge in Illinois.

The judge extended Class certification to all residents of the United States or Canada who bought a ticket from Vivid Seats to an event that was canceled, rescheduled, or postponed due to COVID-19 before the settlement’s preliminary approval in April.

Money from the class action settlement will be used to reimburse customers who purchased tickets from Vivid Seats for canceled events. The agreement also extended the deadline for credits given by the company to be used until Dec. 31, 2022.

The plan is to refund customers for the same amount they paid for tickets to canceled events, however, if new claims overstretch the settlement amount, each Class Member will have their fund amount reduced by an equal percentage.

Vivid Seats Class Action Claimed Customers Denied Refunds for COVID-19 Cancellations

Ticket buyers claimed Vivid Seats was guilty of unjust enrichment, breach of contract, and negligent misrepresentation — in addition to multiple state consumer statutes — by denying customers refunds for events disrupted by the COVID-19 pandemic.

Ticketmaster and its parent company, Live Nation, faced a similar class action lawsuit for allegedly changing their refund policies to force consumers to cover the costs of events suspended during the coronavirus outbreak.

  1. Gail Murr says:

I purchased 6 tickets to the Def Leppard/Poison/Metallica/Joan Jett concert and requested a refund PRIOR to the June 30, 2019 deadline. Vivid Seats denied me. The concert was rescheduled twice and now, instead of being on the weekend, it is scheduled for a Wednesday and no one wants to take off work to go to a concert that begins at 4:30 in the afternoon. I never received any notice about the class action lawsuit, and the settlement is closed. Vivid Seats should reimburse everyone!!! Why should I have to try to sell tickets that I lawfully and timely requested a refund for?

    1. SHELLENE WYRICK says:

      I have the same situation!

      1. Lesley Riley says:

Same but I don’t even show as having tickets to the rescheduled show either and there is no information anywhere as to when a payout might happen.

        1. Shellene says:

I called the law office and they said payments are to due to go out in June. I don’t have much faith in them as very vague. It’s so frustrating! I’m trying to sell them.

          1. Christie Atkinson says:

Yes, June has came and gone and still no refund. I wonder if we should open a new lawsuit against them because we have not received our payments back yet! It was settled several months back. I guess they are gaining interest on our money. Its funny that you can not speak to anyone, nor do you get an email unless it has been months. This is not only my money, but my co-workers. This makes me look bad because they want their money back for their tickets and I do not have it. They have been very understanding, but at some point I am beginning to doubt we will get it back.

  2. Trina Kauk says:

I bought Eagles tickets thru Vivid Seats for a 2020 concert which was postponed twice and finally in September, 2021 they changed Covid entry requirements. Also changed to Ticketmaster without my approval. Ticketmaster offered a refund which I opted to take but have never got a refund. I filed a BBB complaint against Ticketmaster and they responded that I have to go thru Vivid Seats! I never knew how it went from Vivid Seats to Ticketmaster. Someone has my $500! What a nightmare!

    1. Cheryl Colburn says:

Hey Trina, The same thing happened to us. We opted out as well and even received a confirmation saying we would get reimbursed. We have been going back and forth with vivid seats and ticket master for over a year now….so fustrating. we are out 1500.00!
Just pisses me off that they are able to get away with this shit!

  3. Jacob Villalobos says:

I bought tickets to Hamilton in February and the day after I purchased the tickets, the event got postponed to next year. I contacted Vivid Seats to see if I could get a refund but they didn’t allow it. Unbeknownst to me, it’s only if the event gets cancelled that you could receive a refund but from what I’ve been researching, they haven’t even been giving out refunds. What kind of ticket seller does this?

I then decided to sell the tickets through the app to try and make back any money I possibly could. I eventually was able to sell them but I didn’t know that they took 10% as a sellers fee. I would’ve tried to sell them for much more if this was clearly stated and not hidden behind countless pages of FAQs. After all that trouble, they then said that I will receive my money 7 days AFTER the event has taken place???? Why do they have to do that? I sold them through the app and don’t understand why I can’t just receive the money now. Why do I have to wait a whole entire year to receive money from the buyer? I don’t want this company holding on to that money for an entire year. It doesn’t make sense. I’ve reached out countless times and they refuse to pay me due to the terms of sale that is hidden behind long texts that would take days to read. It’s ridiculous and I hope people don’t get fooled the way I did.

  4. Susan L Hall says:

I completed paperwork to claim a refund on 3 tickets that I purchased form Vivid Seats for the 2019 CMA festival, but never received a refund. Please contact me.

  5. Zach Ott says:

During Covid vivid seats is charged three times the amount for concerts Cell saying that tickets were sold out when they weren’t. I contacted the venue they have not been sold out this whole time there a racket it’s a legal and they need to have something done to them and they can’t give any money back because they say that it was going to a third-party seller which is a load of crap.

  6. Lynnitra Mcdowell says:

So I have been waiting for a refund for since 2020 and I call today and they said they are having the concert in July can I get my money! And it clearly states if you purchase tickets and the event is cancelled you get a full refund

  7. Francis Beracha says:

Does anyone know when we get our money back? They never answer their emails and their phone number is an automated machine. Its so frustrating! Its been over 2 years already! When will we be receiving our checks? Unbelievable.

  8. Tracy Wilson says:

I purchased Elton John tickets for a concert that was supposed to take place in 2020! When I contacted vivid seats (horrible company), I was told I wouldn’t be refunded unless the performer cancelled the concert. I have over $700 sitting in someone’s pocket and have yet to attend the concert!! I was promised an upgrade and all sorts of BS perks if I allowed them to keep my money until the reschedule date. If I charged them finance charges like a bank they would owe me a lot more then $700!! I have never purchased tickets from a 2nd hand seller and will NEVER do so again. I still have my tickets supposedly the concert is this April? This company definitely changed the rules to suit their purpose!!

    1. Kimberly says:

I am in the same boat as you. Bought in early 2020 for concert in 2020 and refuse to refund tickets because event was only postponed and not cancelled.

    2. Melissa says:

100% agree. In same boat for over $700.00 for tickets I purchased for a concert pre pandemic, that will now never happen. Total crap they are holding our money hostage!

  9. Laurie Griffin says:

I purchased Matchbox 20 tickets..Yesterday they postponed for the 3rd time..I don’t even live i Florida anymore whete the original concert was…Now its postponed until next year 2023

  10. Shellene Wyrick says:

We purchased 4 tickets for a weekend to see Motley Crue, Def Leppard, Joan Jett, and Poison in December 2019. The concert was postponed twice and is now scheduled for a Tuesday night – who can do that at 4:30 pm when we all have jobs?! I tried and tried to get a refund to no avail. I was told they do not refund. How do I get my money back now?

    1. Kelly L says:

I am in the same boat with the same concert. I have moved and now at a loss as to how I get the $700 back…I even submitted the class action information I received in the mail back in April or May of last year (before our move). How long do we need to wait to get this refund? It is absolutely infuriating.
