Vivid Seats Class Action Settlement Overview: 

  • Who: A federal judge gave final approval of a $7.5 million class action settlement between Vivid Seats LLC and its customers.
  • Why: Ticket buyers claimed Vivid Seats changed its event cancelation refund policies following the onset of the COVID-19 pandemic.
  • Where: The class action lawsuit was filed in Illinois federal court.

The $7.5 million Vivid Seats class action settlement between an events company and ticket buyers who claimed it changed its refund policy for canceled events following the onset of COVID-19 was given final approval by a federal judge in Illinois.

The judge extended Class certification to all residents of the United States or Canada who bought a ticket from Vivid Seats to an event that was canceled, rescheduled, or postponed due to COVID-19 before the settlement’s preliminary approval in April. 

Money from the class action settlement will be used to reimburse customers who purchased tickets from Vivid Seats for canceled events. The agreement also extended the deadline for credits given by the company to be used until Dec. 31, 2022. 

The plan is to refund customers for the same amount they paid for tickets to canceled events, however, if new claims overstretch the settlement amount, each Class Member will have their fund amount reduced by an equal percentage. 

Vivid Seats Class Action Claimed Customers Denied Refunds for COVID-19 Cancellations 

Ticket buyers claimed Vivid Seats was guilty of unjust enrichment, breach of contract, and negligent misrepresentation — in addition to multiple state consumer statutes — by denying customers refunds for events disrupted by the COVID-19 pandemic. 

Ticketmaster and its parent company, Live Nation, faced a similar class action lawsuit for allegedly changing their refund policies to force consumers to cover the costs of events suspended during the coronavirus outbreak.

    It seems there are so many wanting to know status of payout from the class action suit Nellis, et al. v. Vivid Seats LLC , Case No. 1:20-cv-02486 (ND Ill.).
    I sent my claim form and received confirmation to be included in class action suite June 7, 2021. I have sent the law firm several emails inquiring to the status and called the 800 number only to receive a “boiler plate” email respond to be patient. I don’t understand why the law firm will not provide a clear communication on what is going on and when or if those who completed the claim form will ever get any payout from the suit. I’m out $1,200 on purchased tickets from Vivid Seats for an event that was cancelled due COVID-19; whereas Vivid Seats refused to refund the purchase amount money for tickets in accordance to their 100% money refund guarantee.from Vivid seats. Everyday folks can’t afford to be scammed out of their hard earned money. Now this law firm doesn’t seem any better than Vivid Seats in honoring what they said they was going to do,

        Same. When I received communications letting me know how my refund would be issues, the card number was not even the same as the one i used for purchase. I called upwards of a dozen times and reached no one to correct this issue. Every time I called I was prompted to enter my event or ticket ID and it always said “event cancelled” and disconnects. I still have yet to see a payout

          Hi…thought you might want an update … I entered the lawsuit about the same time as original poster and I GOT A CHECK for EXACT amount I paid $394.85!!
          I actually went back and like others thought the settlement was a scam.
          NOPE- the checks are out and I am I’m shock.
          I was SOO mad Ticketmaster tried to do the same thing and got that money too.

          I received my refund check, deposited it, and it bounced and cost me another ten dollars. Livid to say the least, so done with this company.

            It’s reassuring to know I’m not the only one this happened to. 1st it took 2 years to get refunded! Now I deposited the check and it bounced!!!! I got a 12.50 returned check fee and 3 overdraft fees due to paying off bills with refund. so now im still out my original purchase money but now have fees from the bank! If you consider inflation and possible investment loss from them holding refund hostage for years! , the refund should account for at least a bit more than amount originally paid. but with the check bounce and fees Im so mad, Im ready to sue them again! for my bank fees and lost inflation or interest accumulation or perhaps for the anxiety attack Im having right now about this whole train wreck.

    Purchased lumineers concerts 2019 x2 – postponed twice and for several months third scheduled date was TBD. Finally, august 2022 show scheduled and unable to attend. I attempted to sell the moment tickets were available through vividSeats, Ticketmaster and Craigslist. No luck. No ability to get a refund as show wasn’t “canceled.” Tickets were also being listed cheaper on both websites. So frustrating.

      I got my check yesterday …. Full amount ….I am in total shock.
      I figured IF the lawsuit was legit no way they would refund total amount but I will be damned they did.
      I’m cashing it tomorrow 👍👍👍👍👍👍

          Be careful!!! I cashed my check and it bounced! I then paid bills assuming the check was legit. False overdraft fees check denied! Im so ticked off I want to sue this company all over again!!
