IVC filter complications Cook BardA new Cook Medical IVC filter lawsuit has been filed within the Cook Medical IVC filter multidistrict litigation, or MDL, by a man who claims personal injuries as a result of the medical device.

Plaintiff Vincent S., a Texas resident, has named Cook Inc., Cook Medical LLC and William Cook Europe ApS as defendants in his IVC filter lawsuit. Vincent had the Cook Celect vena cava filter implanted in his body on Nov. 5, 2012 in a Louisiana hospital, according to his Cook Medical IVC filter lawsuit.

Vincent has brought forth a number of counts against the defendants including strict products liability for failure to warn and design defect, negligence, negligence per se, breach of express warranty, breach of implied warranty and punitive damages.

The Cook Medical IVC Filter Lawsuit is Case No. 1:17-cv-01015-JMS-DML. It is part of the Cook Medical IVC Filter MDLIn re: Cook Medical Inc., IVC Filters Marketing, Sales Practices and Products Liability Litigation, MDL No. 2570, in the U.S. District Court for the Southern District of Indiana, Indianapolis Division.

What is the Cook Celect IVC Filter?

The Cook Celect IVC filter is a small medical device that is implanted into the vena cava, the body’s largest vein. It prevents serious complications that could result from blood clots. While many patients take oral anticoagulant medications to prevent blood clots, some are unable to do so and require another method of blood clot prevention, such as an IVC filter.

The Cook Celect IVC filter acts to trap blood clots that may travel from the lower extremities back to the heart or lungs. Blood clots traveling from the lower part of the body get caught in the fingerlike projections of the IVC filter where the body causes them to dissolve.

The blood clots are stopped from traveling to the heart where they can cause a heart attack or stroke, and they are also prevented from traveling to the lungs where they can cause a potentially fatal pulmonary embolism.

Complications Resulting from the Use of the Cook Celect IVC Filter

While the Cook Celect IVC filter can be life-saving for many patients, it can also cause serious complications and even death and others. A number of complications have been reported with Cook Celect IVC filter use including:

  • Perforation of the aorta or duodenum
  • Filter migration to other areas of the body
  • Filter tilting, rendering it less effective or useless
  • Filter misplacement
  • Filter fracture (broken off pieces can travel to other parts of the body)
