Beach Bunny Swimwear class action overview:

  • Who: Plaintiff Alin Pop filed a class action lawsuit against Beach Bunny Swimwear Inc. and social media influencers Lady Amelia Labrador, Alexandra Abbate, Anabel Sanchez, Celisa Franco, Tika Camaj and Vlada Glukhova.
  • Why: Pop claims the defendants falsely advertised Beach Bunny Swimwear products.
  • Where: The class action lawsuit was filed in California federal court.

A new class action lawsuit claims Beach Bunny Swimwear and a group of social media influencers falsely advertised Beach Bunny products by failing to disclose they were paid to promote them.

Plaintiff Alin Pop claims the influencers misrepresented their connection with Beach Bunny Swimwear by promoting the company’s products on social media without disclosing they were being compensated to do so.

“Relying on the undisclosed advertising and misleading endorsements, Plaintiff and the Class Members purchased BBS products and paid a premium, while the BBS products purchased proved to be of a lower value than the price paid,” the Beach Bunny Swimwear class action says.

Pop wants to represent a nationwide class and a multi-state class of consumers who purchased Beach Bunny Swimwear products during the class period.

Lawsuit: Beach Bunny Swimwear, influencers didn’t disclose paid partnership

Pop argues the defendants devised a scheme to artificially inflate the price of Beach Bunny Swimwear products by having the influencers promote the products while pretending they were disinterested consumers.

“While it is now clear that the Influencers love the free gifts (and the compensation they receive for endorsing BBS), their followers are led to believe that they purchased the products and wear them because they love it,” the Beach Bunny Swimwear class action says, adding: “This is a textbook example of deceptive advertising.”

Pop claims the defendants are guilty of unjust enrichment and negligent misrepresentation and of violating the Federal Trade Commission Act and California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act.

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, punitive and treble damages in excess of $5 million for himself and all class members.

In related news, consumers recently filed class action lawsuits against Shein, Celsius Holdings and Revolve Group, accusing the companies and their influencers of misleading marketing by failing to disclose paid endorsements and inflating product prices.
