CertainTeed Agrees to $103.9M Defective Siding Class Action Settlement

A federal judge on Thursday preliminarily approved a $103.9 million class action lawsuit settlement between CertainTeed Corp. and a class of consumers who alleged the company sold defective siding to thousands of customers across the country and failed to adequately design and test its products before placing them on the market.


The CertainTeed siding class action settlement will cover all individuals or entities that owned, as of September 30, 2013, homes, residences, buildings or other structures located in the United States, on which specific CertainTeed products were installed on or before September 30, 2013. The class action settlement will allow owners of properties where failed CertainTeed siding was installed to claim cash payments proportionately based on criteria including the size, age and condition of the damage. Class Members will have up to six years to file a claim, according to the agreement.

U.S. District Judge Thomas N. O’Neill, Jr. preliminarily approved the CertainTeed class action settlement on October 3, 2013. A Final Approval Hearing is scheduled for February 19, 2014.

The CertainTeed siding settlement resolves numerous class action lawsuits about alleged product defects that were filed against CertainTeed in 2010. In 2011, the U.S. Judicial Panel on Multidistrict Litigation transferred all cases to the Eastern District of Pennsylvania. The products included in the class action lawsuits are CertainTeed’s Weatherboards Fiber Cement Siding, Lap Siding, Vertical Siding, Shapes, Soffit, Porch Ceiling, and 7/16” Trim.

According to the consolidated class action lawsuit, CertainTeed manufactured and marketed its fly ash-based siding products as durable, long-lasting and appropriate for use on homes. Plaintiffs, however, complained they noticed large gaps between siding boards on their houses years after purchasing homes built with the siding.

Plaintiffs in the CertainTeed class action lawsuit also complained that aside from shrinking, cracking and warping, the siding also tends to freeze during winter. It also allegedly displays poor paint adhesion and significant moisture absorption.

The class is represented by H. Laddie Montague Jr., Lawrence Deutsch and Shanon J. Carson of Berger & Montague PC and by Michael McShane of Audet & Partners LLP.

The CertainTeed Siding Class Action Lawsuit Settlement case is In re: CertainTeed Fiber Cement Siding Litigation, Case No. 2:11-md-02270 in the U.S. District Court for the Eastern District of Pennsylvania.

    was the product sold in ky in 1999 or 2000………..I put the lap siding on my house…….it also has gaps

    Need a new roof. Needed a new roof a few years ago but have been patching it

    Fiber cement siding installed 2/2004, shrinkage causing gaps, prefinished color is inconsistent. Boards are warping, making factory edges lift up and breaking at attachments, I have my original receipt for 330 boards. Please include me in this class action suit for $8,553.60 plus labor for removal of defective siding and installation of new siding. Thanking you in advance.

    Our certain teed siding is warping (melting) in summer causing unsightly curves in otherwise level siding.

    my garage is sided with that siding and it has shrunk up to 4-5 inches at the joints and corners, it has also faded please add me to your list.

    My siding is prestained wood look. It is cracking and shrinking in multiple locations and has effervescence in multiple locations.

    my house was built in 2004 using this siding and is warping on the front and back of house with some shrinkage.
