Byetta Pancreatic Cancer LawsuitA new lawsuit claims that a man’s use of the diabetes medication Byetta led to him being diagnosed with pancreatic cancer. It’s a claim raised in dozens of Byetta lawsuits filed across the country.

Donald E. Lilley of Memphis, Tenn., began taking the type-2 diabetes medication around April 2007 and continued taking it until December 2010. According to the Byetta lawsuit, he was diagnosed with pancreatic cancer and died less than two months later.

Hundreds of personal injury lawsuits have been filed over the diabetes treatment drugs Byetta, Januvia, Victoza, and Janumet. The diabetes drug lawsuits all claim that drug makers concealed the heightened risk of developing cancer from Januvia, Victoza, Byetta, and Janumet. Due to the high number of cases involving these medications, they have been centralized into multidistrict litigation in U.S. District Court. While that type of litigation is similar to what would occur with a Byetta class action lawsuit, plaintiffs are still able to pursue their own award via trial or settlement on their own terms.

With that consolidation, however, the judge has issued a master long-form complaint. It allows plaintiffs to submit a brief overview of their case. Since that is the case, there are not many case-specific allegations except for the usage time-frame and date of diagnosis of Byetta pancreatic cancer side effects.

However, in general, the man’s complaint cites counts regarding studies that show a link between the type-2 diabetes medication and carcinogenic effects. In February 2011, one of the key studies indicated that the rate for pancreatic cancer was nearly three times higher with the drug Lilley took compared to other treatments. Another piece of research cited by his Byetta class action lawsuit attorney argues that it takes, on average, just a year between beginning treatment and the diagnosis.

Along with other plaintiffs, Mary Lilley, acting on behalf of his estate, alleges that companies including Amylin Pharmaceuticals and Eli Lilly were negligent because they should have been aware of these risks and made them known to both patients and their prescribing doctors.

The Byetta pancreatic cancer side effects lawsuit is Mary Lilley v. Amylin Pharmaceuticals, LLC et al., Case No. 14-cv-0753. It was filed directly into MDL No. 2452, In re: Incretin-Based Therapies Products Liability Litigation, U.S. District Court, Southern District of California.

In general, Januvia pancreatic cancer lawsuits are filed individually by each plaintiff and are not class actions.
