A new class action lawsuit accuses ButcherBox of violating California’s Automatic Renewal Law by failing to make clear and conspicuous disclosures about its subscription service.
Plaintiff Dallas James claims ButcherBox’s website does not provide clear information about its automatic renewal terms, including how to cancel the service.
James says he purchased a subscription to ButcherBox’s meat delivery service in November 2025, but was not aware that the subscription would automatically renew.
According to the ButcherBox class action lawsuit, James was charged $152 for a second delivery in December 2025, which he did not authorize. He says he canceled the subscription after discovering the charge.
James further alleges ButcherBox failed to provide consumers with a retainable record of the automatic renewal terms, cancellation policy or cancellation instructions as required under California’s ARL.
He seeks to represent a class of consumers who purchased a subscription to ButcherBox’s service in California and were charged for an automatic renewal without their explicit consent.
Lawsuit alleges ButcherBox obscured renewal terms, complicated cancellations
James argues the website’s final checkout page does not clearly disclose the cancellation policy, and the post-transaction acknowledgment does not include information about how to cancel the service.
The class action lawsuit also alleges ButcherBox used design features that concealed its automatic renewal terms, including presenting disclosures in small, light-colored text, using difficult-to-distinguish hyperlinks and requiring consumers to confirm their decision to cancel multiple times before completing the cancellation process.
The ButcherBox class action lawsuit asserts claims for violation of the Consumers Legal Remedies Act, False Advertising Law and Unfair Competition Law.
James is requesting declaratory, legal and equitable relief, including injunctive relief, statutory and punitive damages, and attorneys’ fees and costs.
Recently, tech giant Adobe agreed to a $150 million settlement with the U.S. Department of Justice, including civil penalties, over allegations it used fine print and inconspicuous hyperlinks to hide key information about its subscription plans, including details about early termination fees.
