Bayer Healthcare is facing a massive Essure lawsuit, consisting of over a dozen women claiming they suffered permanent Essure complications from the device.
The Essure birth control product consists of two metal coils, which are directly implanted into each of the fallopian tubes. After a couple months, the tissue of the fallopian tubes will swell and will block sperm to egg conception.
While it has gained massive popularity for its simple sterilization method, numerous women have reported serious Essure complications.
Over twenty different women have filed a conjoined Essure lawsuit, with each alleging serious Essure side effects.
Each of these women allege that due to the defective nature of the Essure birth control product, they became permanently injured. Several of these plaintiffs include:
- North Carolina plaintiff Mandy G. had Essure birth control implanted in Aug. 2007
- Michigan plaintiff Amanda B. had Essure birth control implanted in Sept. 2012
- Michigan plaintiff Altonia C. had Essure birth control implanted in Sept. 2009
- South Carolina plaintiff Carrie C. had Essure birth control implanted in Jan. 2013
According to the Essure lawsuit, each of these women suffered “serious and permanent” injuries soon after having the birth control product implanted.
Many more women have alleged similar claims, stating that the Essure complications had caused permanent impairments on their lives.
Each of these women did not discover the problems associated with the Essure birth control product until Feb. 29, 2016, when the FDA released a public warning regarding Essure side effects.
During the same announcement, the FDA required Bayer Healthcare to add a black box warning to warn against Essure complications. The agency also called for further studies to be conducted on this product, to determine the true safety profile of the Essure birth control product.
Essure Lawsuit Focuses on Complications
According to the Essure lawsuit, these women never would have agreed to use the permanent birth control product if they had known the risks associated with it.
Bayer Healthcare had allegedly advertised the Essure birth control as a safe and convenient alternative to traditional tubal ligation, prompting numerous women to have the device implemented.
The Essure birth control product is the first and only non surgical permanent birth control option on the market, which was originally manufactured by Conceptus Inc.
After Bayer Healthcare aquired the rights to sell the Esure birth control, the company has seen significant financial success.
However soon after its approval in 2002, numerous women reported Essure side effects including: bloating and rashes, allergic reactions, excessive bleeding, organ perforation, and ectopic pregnancy.
Approximately 4,500 Essure complications have been reported since the product’s approval, with many women alleging that this product was not safe for market.
Many of these women have chosen to file legal action against Bayer Healthcare, for failing to warn them against the defects of the permanent birth control.
The Essure Lawsuit is Case No. 2:16-cv-03589 in the U.S. District Court for the Eastern District of Pennsylvania.
In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
