A new class action lawsuit accuses Ashley Stewart of falsely advertising its products as being on sale.

Plaintiffs Brenda Harrison and Sandra Pickens filed the class action complaint against the retailer on June 2 in California federal court, alleging violations of state and federal consumer laws.

Ashley Stewart sells clothing and accessories online and in brick-and-mortar stores. The plaintiffs allege the company engaged in deceptive advertising practices by falsely claiming that its products were on sale when they were not.

According to the lawsuit, Ashley Stewart advertised steep discounts on its products, often claiming that they were 50% off their regular prices. However, the plaintiffs allege that the products were almost always available at the advertised discounted prices, meaning the discounts were not genuine.

The plaintiffs claim that Ashley Stewart’s advertising practices misled consumers into believing that they were getting a good deal and that the discounts were time-limited. As a result, consumers were more likely to make purchases they might not have made otherwise, the lawsuit claims.

Lawsuit: Ashley Stewart fake sales violate consumer protection laws

The plaintiffs argue that Ashley Stewart’s actions violate California’s False Advertising Law, which prohibits businesses from making statements that they know or should know are untrue or misleading.

The lawsuit also alleges that Ashley Stewart violated the state’s Consumers Legal Remedies Act and Unfair Competition Law by advertising false or misleading discounts and failing to disclose the true cost of its products.

The plaintiffs are seeking to represent a nationwide class of consumers who purchased Ashley Stewart products advertised at a discount within the applicable statute of limitations period.

They are suing for breach of contract, breach of warranty, negligent misrepresentation and intentional misrepresentation and are seeking certification of the class action, damages, restitution, disgorgement and a jury trial.

Ashley Stewart is not the only retailer to be hit with a class action lawsuit over allegedly fake sales. A recent class action lawsuit filed in California federal court accuses clothing retailer Akira of inflating original prices to create deceptive “sale” discounts, allegedly misleading consumers into believing they were getting better deals.

    I have been ordering from Ashley an I noticed there prices as they come in new, an then when they are at a 30% discount which is not much, thete discounts are we off everything I placed a order in June an still have not gotten it, I want to be in the lawsuit
