A 60-year-old Louisiana woman filed a Benicar HCT lawsuit in the U.S. District Court, District of New Jersey against Daiichi Sankyo and Forest Laboratories on May 30, 2017.
Plaintiff Lula L. joins other complainants against the developers and producers of this pharmaceutical drug for hypertension in a class action Benicar HCT lawsuit known as multidistrict legislation (MDL) #2606.
What is Benicar HCT?
According to www.webmd.com, Benicar HCT, also generically known as olmetsartan hydrochlorothiazide, is a drug treatment for high blood pressure.
Its twin compounds, olmetsartan and hydrochlorothiazide, are supposed to work together by widening or relaxing blood vessels, allowing for better blood flow through the circulatory system.
The hydrochlorothiazide element is actually a diuretic, a substance that acts on the body to help it eliminate extra accumulated water and salt.
These combined actions are allegedly supposed to lower blood pressure, and reduce the patient’s risk of myocardial infarction (heart attack), stroke and kidney malfunctions. Benicar HCT was approved by the Food and Drug Administration (FDA) on June 5, 2003.
The Plaintiff’s Experience as Stated in Benicar HCT Lawsuit
Lula L. began taking Benicar HCT in December 2012. She claims that because of ingesting this medication, she experienced symptoms of severe gastrointestinal distress which caused her to suffer physically, psychologically and financially.
According to the short form complaint filed with MDL #2606, Lula L. experienced nausea, gastritis, abdominal pain and cramping, diarrhea, and unexpected fatigue.
She lost a significant amount of weight and developed a small bowel blockage. The plaintiff eventually had her gallbladder removed to treat some of these symptoms.
What are the Plaintiff’s Accusations in Benicar HCT Lawsuit?
Lula L., plaintiff in this most recent case, accuses the defendants of multiple counts as follows:
- Counts 1 & 2: Products Liability – Design Defect and Failure to Warn
- Counts 3-7: Negligence – Gross Negligence, Negligence, Negligence Per Se, Negligent Misrepresentation, and Negligent Design
- Counts 8-10: Fraud – Fraudulent Concealment, Constructive Fraud, and Fraud
- Counts 11-12: Breach – Breach of Express Warranties, and Breach of Implied Warranties
- Count 13: Unjust Enrichment
- Count 18: Punitive Damages
According to MDL #2606, Lula L. and other class members in the class action Benicar HCT lawsuit, the defendants failed to reveal physical risks associated with the drug’s ingestion.
If the drug’s makers did not know of these risks, Lula argues, they should have completed longer clinical trials longer than three months.
Lula L. and other plaintiffs in the class action Benicar HCT lawsuit are asking for a jury trial to assess punitive and compensatory damages against Daiichi Sankyo and Forest Laboratories.
She and other plaintiffs in the Benicar MDL are also desirous of reimbursement of any interest and legal fees associated with the case.
The Benicar HCT Lawsuit is Case No. 1:17-cv-03822-RBK-JS, in the U.S. District Court for the District of New Jersey, Camden Vicinage.
