An AndroGel user named Kenneth Aurecchia has filed a lawsuit against AbbVie Inc., the makers of the testosterone supplement, alleging that the drug caused him serious medical complications.
Aurecchia began using prescription AndroGel when he turned 63 years old. The drug was marketed as a safe way to treat his low testosterone levels, he claims in the lawsuit. However, he later suffered from a myocardial infarction, a type of heart attack wherein the supply of oxygen to the heart is blocked. The blockage may have been caused by a blood clot, a potential side effect of taking testosterone.
Androgen supplements like AndroGel are designed to replace testosterone because males produce less and less testosterone as the body ages. For some males, decreasing testosterone levels can become a full-on medical problem, causing fatigue-like symptoms, a lack of energy. However, the prevalence of this syndrome is somewhat controversial, and lawsuits like Aureccchia’s have alleged that drug companies have tried to convince physicians to over-prescribe drugs for the condition.
The testosterone product lawsuit alleges that AndroGel was the cause of Aurecchia’s heart attack. To back up this assertion, the lawsuit cites studies by peer-reviewed medical journals.
According to the AndroGel lawsuit, a 2013 study published in the Journal of Medical Association found that many cases of “low testosterone” were actually misdiagnoses. The JAMA study found that one-quarter of test subjects never even had their testosterone levels measured prior to their “diagnosis.”
Another 2013 study, also published in JAMA, found that there was a 30% increase in the risk of heart attack, stroke, and other blood-clot related illnesses. Yet another study, in the New England Journal of Medicine found similar results.
Dozens of testosterone product lawsuits have been filed in recent months, alleging that not only were the makers of these treatments aware of these risks but that they actively concealed the alleged risks from patients like Aurecchia and their physicians, preventing them from having the information they needed to make informed medical decisions. To support this assertion, the Aurecchia’s lawsuit mentions that the makers of his androgen supplement have sunk tens of millions of dollars into marketing their product. This included efforts to “inform” physicians that low testosterone was widely under-diagnosed and under-treated in an effort to increase sales.
The AndroGel lawsuit states that these marketing tactics have paid off to the tune of $1.4 billion dollars in the US alone, across various androgen product manufacturers.
The Androgel lawsuit is Kenneth Aurecchia v. AbbVie Incorporated, et al, Case No. 1:14-cv-772, filed in the United States District Court for the Northern District of Illinois, Eastern Division.
In general, Androgel heart attack lawsuits are filed individually by each plaintiff and are not class actions.
