Agua Viva Corporation is facing a new semi truck accident lawsuit, alleging that one of their drivers acted recklessly and caused serious injury to the claimant.

The semi truck accident lawsuit was filed by a man from Pennsylvania, alleging the company failed to confirm that their driver was qualified or safe to drive one of their company 18 wheelers.

Plaintiff Matthew H. is also naming driver Rodolfo Garcia in the semi truck accident lawsuit, alleging his reckless driving had placed him and other drivers in life-threatening danger.

According to the semi truck accident lawsuit, Matthew had no way to prevent the incident and was helpless as the truck collided with him and other cars.

Overview of Semi Truck Accident

According to the semi truck accident lawsuit, Matthew was driving a 2017 Toyota Prius northbound on Interstate 83 on a bridge crossing the Susquehanna River just south of Harrisburg, Pa.

Around the time of the semi truck accident, Matthew says the traffic in all lanes of the bridge came to a stop. While Matthew was sitting in traffic, allegedly driver Garcia came barreling down the road from the rear and collided with multiple vehicles and into the side of Matthew’s car.

After the 18 wheeler collided with Matthew, he claims his car was forced along the bridge and presented a serious danger to his life. Due to the fact that the semi truck accident was on a bridge, Matthew says he was worried his car might fall into the water.

According to the semi truck accident lawsuit, Matthew was trapped in his car for 30 minutes before authorities removed him from his car with the jaws of life. He was then rushed to the Hershey Medical Center, he says, where he was diagnosed with several serious injuries including a broken pelvis, broken ribs, lacerated spleen, and a collapsed lung.

Matthew says he had to spend 13 days in the hospital and then one week at a rehab center. Even after all this medical treatment, Matthew says he had to spend several weeks with his parents and is still contending with the chronic injuries.

Matthew opted to file a semi truck accident lawsuit, after discovering the driver of the 18 wheeler had been found guilty of reckless driving. Garcia reportedly pled guilty to charges of careless and reckless driving on July 13, 2017, after authorities had investigated the semi truck accident.

Matthew claims he is in no way responsible for the semi truck accident and had no prior warning of the 18 wheeler coming before hearing the sound of screeching tires and feeling the impact of the truck.

Matthew alleges that Agua Viva Corporation either knew or should have known of Garcia’s potential for reckless driving, which endangered other drivers on the road. Considering that Matthew was driving a typical passenger vehicle, he would not have stood a chance against an 18 wheeler in the event of a semi truck accident.

Overall, Matthew claims Garcia should not have been driving the 18 wheeler in such a reckless manner, which could have prevented the semi truck accident. Matthew is seeking damages for all past and future medical compensation, with his medical bills already exceeding over $250,000.
