Freight company Skymile Logistics has been assessed $3.5 million in damages by a jury that found one of the company’s drivers responsible for another driver’s injuries in a three-semi pileup.
In Mississippi, a federal jury determined that Skymile semi drier Zewdie D. was responsible for a car crash that involved three semis.
In the accident, United States Postal Service truck driver Billy R. was killed, and another truck driver, Derrick F., was permanently injured in the crash. Derrick is a truck driver for Double J Logistics. Reportedly, Zewdie rear-ended Derrick’s truck, and then Billy’s truck hit Derrick’s truck, killing Billy and injuring Derrick.
The $3.5 million truck accident jury award resolves Derrick’s claims against Zewdie and his employer. The jury found that Zewdie was 100 percent responsible for the accident, and was acting negligently.
The attorney representing Derrick said that Zewdie was driving at a speed below the federal minimum speed limit with his lights off. The attorney said that these factors, in addition to the fact that Zewdie failed to pull entirely off of the road, caused the crash.
Derrick says that he suffered a broken arm and a broken hip from the accident. According to Derrick, these injuries will be permanent at least in part. Allegedly, they have resulted in scarring and mobility issues, and he now needs to use a wheelchair or walker when moving around outside of his home.
Though the jury determined that Skymile Logistics should pay $3.5 million in damages, Derrick will not receive that full amount. His payment will be lower because Derrick and Skymile reached a high-low agreement on the last day of the trial.
Under the high-low agreement, proposed by Derrick’s attorney, Derrick would be guaranteed to a certain minimum amount of damages. This guarantee came at a price — the maximum amount of damages he could receive would be capped, regardless of the amount in damages the jury decided on in their truck accident jury award.
The lawyers did not specify what the high and low amounts determined in the high-low settlement were, nor did they say what the other terms of the settlement were.
Reportedly, the $3.5 million truck accident jury award was much higher than either Derrick’s lawyers or Skymile’s lawyers expected. Derrick’s lawyer did say that he believed that the jury came to the right decision in assigning 100 percent responsibility to Zewdie, according to Law360.
Derrick’s lawsuit is not the only legal action that Skymile Logistics has faced over the three-semi crash. The family of Billy, who was killed in the accident, filed a lawsuit in August 2016 against Zewdie, Skymile, and Derrick and his employer, Double J Logistics, for Derrick’s alleged role in the crash and Billy’s resultant death.
Many others who file semi truck accident lawsuits cite negligence or careless driving and hold the drivers and trucking companies responsible.
