Two Texans Rear Ended by a Commercial Truck Allege Severe InjuriesTwo people from Texas allege they were rear ended by a commercial truck and have filed legal action against Clayton Transport Inc. and their driver.

The claimants allege the accident happened due to the “reckless and incompetent” driver hired by Clayton Transport, and the company is responsible for failing to confirm that he was safe to drive such a large vehicle.

Plaintiffs Uriel C. and Robert M. both hail from Webb County. They claim they were rear ended by a commercial truck that Clayton Transport owned and was driven by Troy Dunlap.

According to the truck accident lawsuit, Uriel and Robert were driving along the intersection of the 600 block of northeast Bob Bullock Loop and 10100 IH 35 N. Frontage Road. Their vehicle was rear ended while they were stopped at a yield sign, waiting for traffic to pass, the plaintiffs claim.

The plaintiffs say this area of traffic consisted of two northbound lanes and is controlled by traffic signal lights and yield signs, which should prevent vehicle collisions if proper driving safety is conducted.

Overview of Truck Accident Collision

The truck accident reportedly occurred on Jan. 18, 2018 in early afternoon, with Uriel driving a 2007 Ford 350 and Robert being his passenger. According to the traffic accident lawsuit, Uriel had been stopped at the intersection due to a traffic yield sign and was not aware of the dangers behind him.

During this time, Dunlop had been driving the large Clayton Transport truck behind him and had reportedly driving too fast and allegedly failed to stop. As a result, the two plaintiffs say they suffered a multitude of serious physical injuries.

According to the truck accident lawsuit, Uriel had sustained cervical and lumbar sprains and strains, along with multiple disc bulges to his neck and lower back. Uriel has had to undergo extensive physical therapy, daily medication, and injections to control the pain.

Robert had reportedly suffered similar injuries, along with herniations to his lower back and neck and thoracic sprains and strains. Robert says he has also undergone extensive physical therapy and daily injections to help manage his pain, and had to undergo a lumbar laminectomy and discectomy to treat pain in his lower back.

The truck accident lawsuit states that both Uriel and Robert will most likely continue to incur medical expenses in the future, with their quality of life severely impacted by the vehicle collision. Uriel and Robert opted to file legal action against Clayton Transport and Dunlop, after discovering his negligence had caused them to be rear ended by a commercial truck.

According to the truck accident lawsuit, Dunlop had been speeding and failed to lookout for Uriel’s vehicle and did not exercise proper caution when driving a large commercial truck. Dunlop allegedly failed to maintain a clear and reasonable distance with claimants’ vehicle, and changed lanes without checking to make use there was enough room to do so.

Uriel and Robert are seeking damages for all their medical injuries, and alleges multiple counts of negligence against Clayton Transport.

This Truck Accident Lawsuit is Case No. 5:18-cv-00143, in the United States District Court for the Southern District of Texas, Laredo Division.
