After suffering from serious injuries following an accident with a semi truck, a husband and wife have filed a lawsuit against the driver and operating companies accusing them of engaging in negligent behavior.
Plaintiffs Claudia S. and Robert S. recently filed a lawsuit against Impel Union Inc., Delta Carrier Group Inc., and Filip R., alleging that the defendants’ negligence caused a serious collision with a semi truck.
According to the lawsuit, in November 2016, the husband and wife were driving their vehicle in Indiana when they stopped at an intersection. Filip, who was driving a semi truck for Impel Union and Delta Carrier Group, allegedly made a left hand turn in a careless and negligent manner. His turn reportedly caused the tractor trailer of his semi truck to run over the front of Claudia and Robert’s vehicle.
According to the truck accident lawsuit, as a result of the accident, Claudia allegedly sustained a bulging disc in her back which compressed the thecal sac at C4-C5, C5-C6, and C6-C7.
The thecal sac is the sheath which surrounds the spinal cord. The sac contains cerebrospinal fluid which helps provide nutrients to the spinal court.
The affected area of Claudia’s spine allegedly also experienced facet hypertrophy, foraminal stenosis, and myofascial pain syndrome. Foraminal stenosis is a painful condition caused by hypertrophy, or enlargement, of a joint in the spinal column. Myofascial pain syndrome is a chronic pain condition caused by pressure on trigger points in muscle.
The couple claims that the conditions caused by the accident have caused Claudia serious, persistent pain and forced her to undergo medical treatment. Claudia is allegedly also unable to perform her duties at work which has impacted her earning capacity and wages.
The truck accident lawsuit alleges that the accident was directly caused by Filip’s negligence. The plaintiffs claim that Filip “carelessly and negligently operated his tractor trailer semi truck so as to cause a collision with plaintiff’s vehicle and serious injuries to plaintiff.”
The plaintiffs also claim that Filip’s negligent and careless driving failed to follow Federal Motor Carrier Safety Regulations which are in place to prevent semi truck accidents.
The truck accident lawsuit claims that Impel Union and Delta Carrier Group “carelessly and negligently failed to use the care an ordinary tractor trailer semi truck company would have used under the same or similar circumstances.”
Although insurance companies often compensate drivers after a semi truck accident, a truck accident lawsuit may provide victims of damaging accidents an avenue to recover additional compensation.
These lawsuits often argue that the driver was negligent and careless which caused the accident. Plaintiffs may also aim to hold operating companies accountable for allowing allegedly negligent drivers to operate semi trucks on their behalf.
In their truck accident lawsuit, Claudia and Robert claim that sustained a variety of damages including loss of “companionship, society, services, affection, and consortium,” medical expenses, future medical care, loss of expenses, loss of earning capacity and more. The truck accident lawsuit seeks damages, court costs and attorneys’ fees.
