Olympic-rescue-itPPG Industries Inc. has reportedly agreed to pay $6.5 million to settle a class action lawsuit over claims that its Olympic Rescue It! products include design flaws that cause them to fail to adhere properly to decking, causing it to routinely peel, crack, bubble and cause damage to the material to which they are applied.

The original Olympic Rescue It class action lawsuit was filed in Ohio federal court in May 2015.

On April 26, the parties filed the proposed settlement agreement before U.S. District Judge Aaron Polster in the U.S. District Court for the Northern District of Ohio.

The class action settlement documents state the parties have engaged in “extensive, arm’s-length negotiations regarding the settlement of claims involving the Rescue It! Product, including multiple in-person and telephonic conferences.”

The Olympic Rescue It products named in the PPG settlement include:

  • Olympic RESCUE IT! Wood & Concrete Resurfacer
  • Olympic RESCUE IT! Resurfacer + Sealant In One Moderate Restoration
  • Olympic RESCUE IT! Resurfacer + Sealant In One Light Restoration
  • Olympic RESCUE IT! MAX Resurfacer + Primer + Sealant
  • Pittsburgh Paints & Stains Revitalize Wood & Concrete Resurfacer
  • Pittsburgh Paints & Stains Revitalize Wood & Concrete Resurfacer
  • Pittsburgh Paints & Stains Revitalize Resurfacer & Sealant In One Light Restoration
  • Pittsburgh Paints & Stains Revitalize Resurfacer & Sealant In One Heavy To Moderate Restoration

 

PPG denies all of the allegations of fault, wrongdoing and liability claimed in the Olympic Rescue It class action lawsuit and maintains its products are not defective. However, the company has agreed to a class action settlement to avoid the burden and expense of ongoing litigation.

Class Members of the proposed Olympic Rescue It settlement include anyone in the United States who purchased one of the listed Rescue It products between Jan. 1, 2013 and April 26, 2017 and experienced a qualifying problem.

The Olympic Rescue It settlement offers the following benefits to eligible Class Members: reimbursement of the purchase price paid for a Rescue It product purchased during the Class Period; reimbursement of the cost paid to remove the Rescue It products; or reimbursement of the amount paid to replace decks or structures as the result of a qualifying problem.

The Settlement Administrator is not yet accepting claims for this proposed class action settlement, and the settlement has not yet been approved by a judge.

The Olympic Rescue It Class Action Lawsuit is Matthew Traxler, et al. v. PPG Industries Inc., et al., Case No. 1:15-cv-00912-DAP, in the U.S. District Court for the Northern District of Ohio, Eastern Division.

UPDATE: On June 9, 2017, the settlement website is: http://www.rescueitsettlement.com/.  Claim forms will not be available until after the settlement receives final approval from the court.  The final hearing is currently scheduled for August 23, 2017.  There is an option to register in order to receive a claim form after final approval is granted.  Please keep checking Top Class Actions for updates.  We will let our viewers know as soon as the claim form is available!

    Joined Many years ago. Spent a Day with Three People putting it on ,it didn’t expect it to last forever but damn It started peeling in the first year, 2016.. Just want the 250 I spent .One 2.5 gallon was on Sale ,should have been a warning. 165.00 for the additional one I needed. Now I need to powerwash it off and put a stain on.150 at Home Depot to rent.

    Found out about lawsuit for product and filed claim in August 2018. Totally discussed as it has irreparably damaged our deck! We were waiting in hopes of getting a percentage back from Olympia to help pay for redoing the flooring and rails, finally gave up as we have not received anything. I had a contractor come today to get quotes to redo our entire 40 foot long deck in Spring of 2021. The contractor is making note on the quote as to the damage caused by this product, just in case Olympia comes through . Maybe there will be other suits as this one failed us?

    Still waiting to get my settlement claim $’s. This has been going on since August of 2014, all paperwork was submitted which was required, claim form, receipts, measurements, photo’s. Since this in twice just to make sure it was received and 2nd time sent it with a Post Office tracker which showed you did receive it but have not heard one single word from you. I was to get this taken care of – tried of dragging this out.

    After contacting both Attorney’s Offices listed and speaking with one of the Administrative Assistants working with the Class Action I filed all the necessary paperwork that I was instructed to file, including photo’s. I also kept in contact with the Class Action Office for updates. We received a letter in the mail that our claim was denied because of insufficient information. In addition, the letter implied that I had falsified information regarding our claim which I clearly did not! Initially, when I contacted Olympic and prior to being aware of the Class Action Suit, one of the ladies offered us $500.00 which was fine with us. That is when she contacted us and apologized because she was not aware of the lawsuit. Our claim was denied and I refused to appeal since I had wasted enough time and effort in submitting the information. We will NEVER purchase this crappy product ever again and I hope Olympic Tanks along with the Dumb Clown that denied our claim! Either the idiot was drunk, on drugs or simply stupid!! Hello Behr!!!
