Olympic-rescue-itPPG Industries Inc. has reportedly agreed to pay $6.5 million to settle a class action lawsuit over claims that its Olympic Rescue It! products include design flaws that cause them to fail to adhere properly to decking, causing it to routinely peel, crack, bubble and cause damage to the material to which they are applied.

The original Olympic Rescue It class action lawsuit was filed in Ohio federal court in May 2015.

On April 26, the parties filed the proposed settlement agreement before U.S. District Judge Aaron Polster in the U.S. District Court for the Northern District of Ohio.

The class action settlement documents state the parties have engaged in “extensive, arm’s-length negotiations regarding the settlement of claims involving the Rescue It! Product, including multiple in-person and telephonic conferences.”

The Olympic Rescue It products named in the PPG settlement include:

  • Olympic RESCUE IT! Wood & Concrete Resurfacer
  • Olympic RESCUE IT! Resurfacer + Sealant In One Moderate Restoration
  • Olympic RESCUE IT! Resurfacer + Sealant In One Light Restoration
  • Olympic RESCUE IT! MAX Resurfacer + Primer + Sealant
  • Pittsburgh Paints & Stains Revitalize Wood & Concrete Resurfacer
  • Pittsburgh Paints & Stains Revitalize Wood & Concrete Resurfacer
  • Pittsburgh Paints & Stains Revitalize Resurfacer & Sealant In One Light Restoration
  • Pittsburgh Paints & Stains Revitalize Resurfacer & Sealant In One Heavy To Moderate Restoration

 

PPG denies all of the allegations of fault, wrongdoing and liability claimed in the Olympic Rescue It class action lawsuit and maintains its products are not defective. However, the company has agreed to a class action settlement to avoid the burden and expense of ongoing litigation.

Class Members of the proposed Olympic Rescue It settlement include anyone in the United States who purchased one of the listed Rescue It products between Jan. 1, 2013 and April 26, 2017 and experienced a qualifying problem.

The Olympic Rescue It settlement offers the following benefits to eligible Class Members: reimbursement of the purchase price paid for a Rescue It product purchased during the Class Period; reimbursement of the cost paid to remove the Rescue It products; or reimbursement of the amount paid to replace decks or structures as the result of a qualifying problem.

The Settlement Administrator is not yet accepting claims for this proposed class action settlement, and the settlement has not yet been approved by a judge.

        I purchased three gallons installed on my desk after the first winter half of it came up went back to Lowes and complained three more gallons was given to me to replace the old after the next winter it bubbled up and peeled off deck realy looks bad now going to have to power wash off the remaining if it will come up what a mess.
