Olympic-rescue-itPPG Industries Inc. has reportedly agreed to pay $6.5 million to settle a class action lawsuit over claims that its Olympic Rescue It! products include design flaws that cause them to fail to adhere properly to decking, causing it to routinely peel, crack, bubble and cause damage to the material to which they are applied.

The original Olympic Rescue It class action lawsuit was filed in Ohio federal court in May 2015.

On April 26, the parties filed the proposed settlement agreement before U.S. District Judge Aaron Polster in the U.S. District Court for the Northern District of Ohio.

The class action settlement documents state the parties have engaged in “extensive, arm’s-length negotiations regarding the settlement of claims involving the Rescue It! Product, including multiple in-person and telephonic conferences.”

The Olympic Rescue It products named in the PPG settlement include:

  • Olympic RESCUE IT! Wood & Concrete Resurfacer
  • Olympic RESCUE IT! Resurfacer + Sealant In One Moderate Restoration
  • Olympic RESCUE IT! Resurfacer + Sealant In One Light Restoration
  • Olympic RESCUE IT! MAX Resurfacer + Primer + Sealant
  • Pittsburgh Paints & Stains Revitalize Wood & Concrete Resurfacer
  • Pittsburgh Paints & Stains Revitalize Wood & Concrete Resurfacer
  • Pittsburgh Paints & Stains Revitalize Resurfacer & Sealant In One Light Restoration
  • Pittsburgh Paints & Stains Revitalize Resurfacer & Sealant In One Heavy To Moderate Restoration

 

PPG denies all of the allegations of fault, wrongdoing and liability claimed in the Olympic Rescue It class action lawsuit and maintains its products are not defective. However, the company has agreed to a class action settlement to avoid the burden and expense of ongoing litigation.

Class Members of the proposed Olympic Rescue It settlement include anyone in the United States who purchased one of the listed Rescue It products between Jan. 1, 2013 and April 26, 2017 and experienced a qualifying problem.

The Olympic Rescue It settlement offers the following benefits to eligible Class Members: reimbursement of the purchase price paid for a Rescue It product purchased during the Class Period; reimbursement of the cost paid to remove the Rescue It products; or reimbursement of the amount paid to replace decks or structures as the result of a qualifying problem.

The Settlement Administrator is not yet accepting claims for this proposed class action settlement, and the settlement has not yet been approved by a judge.

UPDATE: On June 9, 2017, the settlement website is: http://www.rescueitsettlement.com/.  Claim forms will not be available until after the settlement receives final approval from the court.  The final hearing is currently scheduled for August 23, 2017.  There is an option to register in order to receive a claim form after final approval is granted.  Please keep checking Top Class Actions for updates.  We will let our viewers know as soon as the claim form is available!

    I contacted Thomas Malone of The Malone Firm LLC , and was signed up as a lead plaintiff on March 31st 2015. (I had purchased and applied Olympic Rescue it some time before).
    All my attempts to contact the Malone fime by email have not been successful.
    Any suggestions as to what i should do now?

    Product was hard to adhere to the deck even though it had been cleaned. We purchased the “paint” at Lowe’s of Anderson and from the minute it started going onto the wood it was a wreck. I had 2 men helping me, so the application went on pretty quickly, but it looked like a gob of mess. Today 2 years later it has just disintergrated The lumps can be pulled of with your fingers, but where there was no lumps it is impossible to get the mess off. I have used several cleaners with a pressure washer and nothing changes. Very disappointer with this highly recommended product. Yuk.

    I purchased the product in Rome Georgia at Lowes. It was very expensive considering the cost of similar products but it was highly recommended by Lowes employees so I bought it. I put it on the deck on the back of my house and on 2 porches on my out buildings. It started peeling and bubbling after the first cold spell. I contacted Lowes but they could not help so I contacted the company with my problem. I was reimbursed my purchase cost plus $200.00 I paid the man that helped me. I signed and returned the waiver because I believed them when they sent instructions on how to remove it. Needless to say, the instructions included a lot of pressure washing and many, many, many hours of work for this great grandmother. The work did not pay off. My deck and porches look like something you would see at a junk yard. It is a shame you cannot believe people you are dealing with. When I received your card about the law suit I became very hopeful that I would get some help in repairing this “mess”. The waiver I signed should be void because the information it contained was not truthful. I will look forward to hearing from you. Thank you in advance.

      I wish Herman J Weihrauch Technical Service Representative with PPG Architectural Coatings had of given Me $200.00. All They did was give Me more of The Same Defective Paint. So I have two times of scraping, sanding, preparing and painting My decks. And I was told by Rescue-it Admin. that I signed a waiver of Rescue-it being responsible and that is not true. I never signed anything. Now I get it that They might not be responsible for the First (blue) Paint that I used but why not the Second (brown) Paint that I used? If I had of been offered The Money Back that I spent on This Horrible (same as You, Lowe’s advised Me to use it) Product I wouldn’t even be talking about it now because I would have purchased something different. I learned My lesson the first time by Rescue-it forced Me to use it a second time by not allowing Me a choice of whether or not I wanted to. Big business runs over all of Us,. But I am not going to let this go. Twice snake bit is enough for this disabled lady.

    I purchased the product from Lowe’s in kanawha city its the worst paint i have ever brought i have pictures of it it post been brown well it ended up orange it started peeling cracking looked so bad i called told rescue it when it started happen i can not find my Lowe’s was helpful in not recovering the purchase price, i cannot find my recipeds i payed in cash 4 gals of 2.67 gals.i still have a little in bucket here just in case i need to show so one not to buy it and i will thats ashame everyone payed that much for for that stuff and it dont do what it post to do I have been unable to obtain a claim form and need help.

      Dear Reba Holsten, If You purchased it from Lowe’s and use a MyLowe’s Card You can go back into Your Purchase History and print out Your receipts. I hope You can have a MyLowe’s Card, Problem solved, even with Cash, it will be there as Cash. Hope I have helped You, Donna.

    I used this product under the Revitalize brand. We have a deck that is over 6–sq ft. that is now ruined and has to be completely stripped and refinished. I contacted PPG and they sent me a settlement form and a negotiated cash offer (along with a waiver). The also included information about this class action suit (which i had no idea about until now) The cash offer is minuscule compared to the cost and time it will take to correct this mess.

    I have not signed the settlement and wish to know more about the judgement and opt to file a claim so I can properly address this. My question is: is the letter that PPG sent to negate or waive my right to a settlement via the lawsuit?

    The worst painting product I have ever used. It was also the most expensive relative to other deck stain and paint products. It cracked and peeled the first winter. An orbital sander did not totally remove what did not peel, so I am going the route of a drum sander. Truth in advertising does not apply with the Rescue It product with claims of +10 years.

    I purchased the product from Lowe’s in Tifton, Ga. The product immediately began to peel.I took photo’s and Lowe’s was helpful in recovering the purchase price, but I had thousands of dollars in sanding and preparing the deck for a different product. I have been unable to obtain a claim form and need help.

    My rescue It paint started peeling off after the first winter. Now I have to sand the whole deck down. The steps alone took about 4 weeks !!! Where can I find the claim form.
