TripleFlex joint health settlementPharmavite LLC has reportedly agreed to pay more than $1.9 million to settle a class action lawsuit alleging it made false and/or misleading claims on the labeling and packaging of its NatureMade-brand TripleFlex supplements.

The TripleFlex supplement class action lawsuit was initially filed in May 2011 and asserted claims under the California Consumers Legal Remedies Act, California Unfair Business Practices Act and breach of express warranty. The safety of the TripleFlex supplements was not at issue in the deceptive labeling class action lawsuit.

Plaintiff Lorean Barrera claims the NatureMade TripleFlex products failed to provide the joint health benefits that were promised on the product labels. She accused the company of falsely claiming that its joint health supplements were capable of “replenishing the body with key nutrients,” a claim she says was not backed with scientific data.

Pharmavite has denied the allegations and stands by its products. However, the supplement maker agreed to settle the NatureMade TripleFlex class action lawsuit to avoid the burden and expense of ongoing litigation.

Class Members of the NatureMade supplement settlement include all U.S. residents who purchased the covered TripleFlex products since May 13, 2007 and the preliminary approval date.

According to the TripleFlex class action settlement documents, Class Members who submit timely and valid Claim Forms are entitled to receive a cash award (for up to four bottles of the product) and/or a product award (good for up to six bottles of offered products). Class Members who submit proof of purchase with their Claim Forms can request a payment of $25 per bottle and Class Members who do not submit proof of purchase may request $12.50 per bottle.

The actual amount of compensation each claimant receives may be increased or reduced on a pro rata basis, depending on the total number of approved claims.

In addition to providing these benefits to Class Members, Pharmavite has also agreed to discontinue, for a period of 24 months, the use of the following terms to describe the effect of glucosamine and/or chondroitin on cartilage: “rebuild,” “rebuilds,” “rebuilding,” “renew,” “renewing,” “renewal,” “rejuvenate,” “rejuvenates,” “rejuvenation,” or “rejuvenating.”

Pharmavite will not be required to recall, repackage or relabel the products or remove them from store shelves.
