HealthTap Class Action Settlement Checks in the Mail

Viewers of Top Class Actions are reporting they have received checks worth $75 from the HealthTap class action settlement.

The HealthTap settlement resolved a class action lawsuit alleging the health information company violated the Telephone Consumer Protection Act (TCPA) by sending unsolicited fax advertisements to doctors, health clinics and other persons and entities.

The Telephone Consumer Protection Act is a federal law that protects consumers from unwanted communications. It prohibits companies from making phone calls, sending text messages or faxes without the prior express consent of the consumer. Each violation of the TCPA can result in a $500 fine. However, companies found to have willfully violated the TCPA may be subjected to a $1,500 penalty for each violation.

HealthTap Inc. is an interactive health company that allows patients to ask medical questions to a panel of doctors through the HealthTap app or the HealthTap website. The HealthTap class action lawsuit alleged the company violated the TCPA by faxing advertisements to businesses and individuals without their prior express consent.

HealthTap denied any wrongdoing but agreed to settle the class action lawsuit (Neurocare Institute of Central Florida PA v. HealthTap Inc., et al.) to avoid the risk and expense of going to trial.

Class Members of the TCPA class action settlement include individuals and businesses that were sent a fax between Jan. 1, 2011 and Dec. 31, 2012 on behalf of HealthTap that described services offered by HealthTap. Under the terms of the TCPA class action settlement, Class Members could elect to receive up to $75 cash or $495 in free HealthTap services.

The deadline to file a claim for the HealthTap class action settlement passed on Sept. 15, 2014.
