Brazilian BlowoutUPDATE 1: Details on how to file a claim for the Brazilian Blowout Class Action Settlement are up!

UPDATE 2: A California judge granted final approval to the Brazilian Blowout class action settlement on Dec. 24, 2013. Settlement checks will be mailed within 30 days after the Effective Date.

It looks like the $4.5 million Brazilian Blowout class action lawsuit settlement we reported on last March may finally get approved.

Los Angeles Superior Court Judge Elihu M. Berle told attorneys yesterday that he was “pleased there have been some adjustments” to the Brazilian Blowout class action settlement, which he expressed concern over when it was first entered in March 2012.

The manufacturer of Brazilian Blowout, GIB LLC, agreed to pay $4.5 million to resolve claims it failed to warn consumers that the popular hair-straightening product emits toxic formaldehyde gas, a known carcinogen, even though the product labels said it was “formaldehyde-free.”

Consumers will receive a $35 payment for each Brazilian Blowout treatment they purchased, up to three total, under the class action lawsuit settlement. Hair stylists will receive $75 for each bottle of the product they purchased.

The difference in compensation is likely due to the fact that hair stylists suffered more injury from their repeated contact with the formaldehyde in the product. Salon staffers reported in numerous lawsuits that they suffered side effects such as eye irritation, nosebleeds, and difficulty breathing from breathing in the product’s fumes.

A total of eight lawsuits were filed in California against GIB, which were consolidated into a single class action lawsuit before Judge Berle.

Berle said Thursday that as long as a few additional changes to the agreement are made, he would approve the Brazilian Blowout class action settlement at preliminary approval hearing set for June 5.

The case is In Re GIB LLC Cases, Case No. JCCP 4657, in the Superior Court of the State of California, County of Los Angeles.

The plaintiffs are represented by Elizabeth C. Pritzker of Pritzker Law and Laura J. Baughman of Baron & Budd PC.

    How do I file for this ?? :( the Brazilian blowout ruined my hair completely when I was 11 in 2009 or 2010… I’m 25 years old now. It made my hair stop growing the way it did, and i basically became almost bald. I’m only 25 years old please help

    I submitted a valid claim and secured my claim # in 09/2013 as the deadline was 09/23/2013. Haven’t heard anything lately and garner it will be awhile.
