Brazilian Blowout

Brazilian Blowout has agreed to pay a $4.5 million class action lawsuit settlement to resolve claims it failed to warn consumers that its popular hair-straightening product emits toxic formaldehyde gas, a known carcinogen, even though the product labels said it was “formaldehyde-free.”

Under the terms of the Brazilian Blowout settlement, consumers who claim they were harmed by the product can receive a $35 payment for each bottle of Brazilian Blowout they purchased. In addition, Brazilian Blowout can no longer market its product as “formaldehyde-free,” and must provide more detailed instructions on how to use it safely.

The proposed $4.5 million Brazilian Blowout class action lawsuit settlement is pending approval from Judge Elihu Berle of Los Angeles Superior Court.

Earlier this year, North Hollywood, California-based Brazilian Blowout agreed to pay $600,000 in fees and penalties as part of a settlement with the California attorney general’s office. The settlement also requires the company to warn consumers that its product emits formaldehyde gas.

The class action lawsuit and California AG investigation stemmed from numerous complaints from hair stylists that the product was causing nosebleeds, breathing problems and eye irritation.

Last year, the Food and Drug Administration issued a warning letter to Brazilian Blowout to stop mislabeling its product as formaldehyde-free. An FDA spokesman said this week that its inquiry into Brazilian Blowout was continuing.

UPDATE 2: A California judge granted final approval to the Brazilian Blowout class action settlement on Dec. 24, 2013. Settlement checks will be mailed within 30 days after the Effective Date.

    I have been harmed by this product and I was just a customer getting a haircut while the procedure was being performed. Both my hair dresser and I turned red in the face with burning on the skin, swollen nasal passages, metallic taste, watering eyes and breathing difficulties that continued for me. It has been 5 days now and my lung fields are still edematous and I have a productive cough. I have laryngitis and can barely talk and run out of air by the end of a sentence. I do not have HEALTH INSURANCE so have not been to a doctor, although i work in the medical field. DOES ANYONE KNOW WHAT MY BEST COURSE OF ACTION SHOULD BE? Can I sue the Salon for my medical bills? Or get in on a lawsuit for second-hand exposure? The salon has been told repeatedly to not do Blow OUTS without warning the stylists and customers. And they do not have a California PROP 65 warning anywhere to be seen. HELP… I AM GETTING WORSE DAILY.

    ALL OF OUR EYES WATERED AND NASAL PASSAGES DISRUPTED. YOU HEARD COUGHING, SNEEZING, AND WHEEZING. WHY WEREN’T THEY TELLING THE TRUTH ABOUT THIS PRODUCT? PEOPLES HAIR HAVE FELL OUT IN PATCHES BEHIND THIS PRODUCT. IN MY OPINION, THIS PRODUCT NEEDS MORE MONITORING AND IF IT ISN’T MADE LESS TOXIC AND DANGEROUS, AND IF THE LABELS AREN’T MORE ACCURATE AND DETAILED, THEN IT NEEDS TO BE REMOVED OFF THE MARKET. THEIR MAYBE CERTAIN PEOPLE WHO SHOULD NEVER ATTEMPT TO USE THIS PRODUCT BECAUSE OF ILLNESS OR A HAIR ISSUE, BUT WE WEREN’T TOLD THIS. I WAS TOLD IT WAS CHEMICAL-FREE AND MORE OF A NATURAL PRODUCT, WHICH IS WHY SOME OF THE AFRICAN AMERICAN WOMEN THAT I KNOW RESORTED TO THIS PRODUCT AND DROPPED THE CHEMICAL PERMS CONTAINING LYE BOXED IN LOCAL STORES…. WALMART, TARGET, SALLY’S , ETC. AND DID AWAY WITH STRAIGHTENING OF HAIR ALL TOGETHER AS WE WERE GETTING HAIR BREAKAGE, THINNING, AND OTHER SORTS OF ISSUES.

    I HAVE HAD A 1 TREATMENT DONE AND I CAN TELL YOU THE FUMES EMITTED FROM THIS PRODUCT WERE DANGEROUS. MY STYLIST HAD TO ADD EXTRA VENTILATION AT THE PAUL MITCHELL SCHOOL. SINCE THEN, THEY HAVE DISCONTINUED PERFORMING THESE TREATMENTS… NO MORE BRAZILIAN BLOWOUTS ARE CONDUCTED AT THIS SCHOOL HERE IN CHARLOTTE, NC.
