An Indianapolis man says a Fort Lauderdale-based real estate investment firm illegally used robocalls to contact him and others on the Do Not Call Registry.

In a class action lawsuit filed in Florida federal court Wednesday, May 12, Lead Plaintiff Mason Yount alleges Freedom Home Offers LLC violated the federal Telephone Consumer Protection Act by making pre-recorded calls to consumers without their consent.

Yount filed the class action after receiving a series of text messages and calls from Freedom Home Offers beginning April 27, 2021, according to the lawsuit.

In the first text message Yount received, the sender asked if Yount had a “fixer upper property” in Indianapolis he was considering selling, and offered to buy any such property “for cash.”

Per the lawsuit, the voicemail message that plays after calling the phone number that sent that text begins with “Hi, this is Roman from Freedom Home Offers.”

One day after receiving that first message, Yount received a call from another phone number, which he did not answer. In that message, someone identifying themselves as “Amy” stated they were not a realtor and were looking to purchase a home for cash, the lawsuit alleges.

“This pre-recorded message was very similar to the pre-recorded voicemails that other consumers complained of receiving from the same phone number,” according to the lawsuit, and anyone who calls the number is connected to an agent from Freedom Home Offers. The lawsuit notes that multiple consumers have posted recordings of similar calls from the same phone number to Youmail.com.

“The Plaintiff does not have any existing business relationship with Freedom Home Offers, or any of its affiliated companies. The Plaintiff did not provide his consent to the Defendant to contact him in any way,” the lawsuit says. “Simply put, Freedom Home Offers did not obtain Plaintiff’s prior express written consent to place any pre-recorded telephone calls to Plaintiff.”

The lawsuit claims Yount was harmed “in the form of annoyance, nuisance, and invasion of privacy” by the unauthorized robocalls.

“Freedom Home Offers engages in aggressive telemarketing and cold calling to find consumers who are looking to sell their properties,” the lawsuit claims.

Yount is seeking injunctive relief to require Freedom Home Offers to stop making automated, unsolicited calls to consumers. He is also seeking statutory damages to members of a proposed Class consisting of everyone who received pre-recorded calls on their cellphones from Freedom Home Offers in the four years prior to the filing of the lawsuit.
