Citibank is facing a robocall lawsuit.

Citibank repeatedly harassed and annoyed a consumer with illegal robocalls, despite being told to stop calling, a new lawsuit alleges.

The lawsuit was filed in Maryland on May 7 by Plaintiff Peniel Bikila, who alleges the bank repeatedly called his cellphone using an artificial or prerecorded voice, even after he told the bank to stop calling him.

“Plaintiff was annoyed, harassed and inconvenienced by Defendant’s continued calls,” the claim states.

According to the lawsuit, when Bikila answered the calls from Citibank, he heard a prerecorded message and had to wait on the line before he was connected to the next available representative.

“In or around December 2020, Plaintiff spoke with a live representative and requested that Citibank cease placing calls to him,” the claim states.

“In complete disregard of Plaintiff’s cease request, Citibank continued to place calls to Plaintiff’s cellular telephone number using an artificial or prerecorded voice.”

The lawsuit says that Citibank’s calls were not placed for emergency purposes and were in violation of the Telephone Consumer Protection Act (TCPA).

“Defendant placed automated calls to Plaintiff’s cellular telephone number despite knowing that it lacked consent to do so. As such, each call placed to Plaintiff was made in knowing and/or willful violation of the TCPA.”

Bikila is seeking $500 for each call made in violation of the TCPA, and $1,500 for each call made in knowing and/or willful violation of the TCPA. He is also seeking a jury trial.

Citibank isn’t the only bank to be facing legal action for robocalls. In April, Jakub Madej filed a lawsuit against JP Morgan Chase for alleged incessant robocalls that forced him to change his phone number. He said that he received at least 88 robocalls from the bank between Dec. 20, 2020 and March 13, 2021.

Also in April, phone carriers R Squared and Tellza were officially put on notice from the Federal Communications Commission (FCC) for facilitating illegal robocalls. The FCC sent letters to both companies telling them to “cease transmitting such traffic immediately and take steps to prevent your network from continuing to be a source of apparently illegal robocalls,” or face being blocked from phone networks.
