USAA class action lawsuit overview: 

  • Who: The United Services Automobile Association (USAA) is facing a class action lawsuit related to its handling of automobile personal injury protection and medical payment claims.
  • Why: USAA is accused of delegating its claims to a third party company’s computer program that improperly reduces or denies USAA claims.
  • Where: USAA’s counsel petitioned to have the case removed from Clark County, Washington, court and moved to the U.S. District Court for the Western District of Washington at Tacoma.

The United Services Automobile Association (USAA) is facing a class action lawsuit claiming that it uses a third party company that improperly reduces or denies claims related to automobile personal injury protection and medical payments.

USAA is accused of using third-party Auto Injury Solutions as part of a multi-faceted USAA claims scheme to implement a computer program called Medical Bill Audit (MBA) for denying claims.

“The MBA process is designed, largely through automated computer processes, to categorically and systematically, without human input, eliminate, abate and/or reduce the amount USAA pays for its insured’s health care expenses based upon its treatment of various codes,” the USAA lawsuit says. 

USAA customers claim insurance adjusters never look at denied claims

The USAA lawsuit plaintiffs Caryn Jennings and Tricia Harder are both Washington residents who had automobile accidents and are part of a class stating that USAA did not investigate their claims and instead used Auto Injury Solutions’ computer model to deny or reduce claims.

USAA has used the program to avoid having a USAA insurance adjustor review the claim or conduct an investigation into the validity of those claims, the USAA class action says.

A September class action lawsuit claims USAA did not properly protect the personal information of clients, resulting in the USAA data breach.

    You can add me. I have had USAA insurance for about 32 years. They have not outright denied any claim of mine or my husbands. But when I was in a car accident back in 2001 it was hard to get good medical care, I still have issues from it – a bruise on my shin from the accident turned out to be damaged blood vessels still visible today – is just one of the issues. I had high coverage, but it seemed that a lot of things they could have done were not. I was young, did not know how to assert myself and I guess I thought others knew what they were doing. My doctor kind of complained a little about the insurance company, but was vague, so I now think they were not approving medical procedures he wanted to do. Since I am paying money on time and consistently to this company to provide a service they need to follow through on their end.

    Add me as I live in an area where people from the city and other countries have moved to so I have had multiple t-bone accidents from people driving on mediums or on purpose not paying attention when my vehicle is stopped in an intersection to turn with t-bone me. I have not had one accident that has not been someone t-boning my stopped vehicle. Bumper get hit or hard enough that the a new engine dies so it’s always a total loss and 1/4 value of the vehicle cost then raised insurance. Don’t worry I got bad TBI and headaches or busted sacral as I get 100% at fault for being stopped completely. Add me even if I don’t get anything as they don’t take care of veterans or military families.

      I just settled with USAA even though I’m still suffering from pains for the accident. I was not paid out what I was supposed be compensation wise.

    We were sideswiped by a tractor-trailer with no injuries. I know that USAA is involved not from my end. However, I have dealt with two other companies that are subcontractors to expedite “settlements.” Seems like they have a similar gig going. A trust and IAA are the companies working with the top.

    I’ve had USAA since 1998. I had my former home and car insurance with them until 2012. Now, I only have car insurance. I had a house fire in 2007. What a nightmare this was. USAA paid BUT I had to find the company to do all the repairs. Led to a lawsuit of personal injury from four black toxic molds in my house. They were protected because they put the responsibility on the company that took the job although USAA should have been required to oversee and make sure this company did their job. Then a minor wreck in 2014 when someone hit me on a college campus. Unfortunately, this person had USAA. They tried to give me the run around. Finally got a rental car but they put cheap parts on my car and the place that fixed it did a lousy job. Had to take it back two or three times. Insurance companies put the burden onto third parties and get out of responsibility. It’s wrong!

      They denied me and didn’t pay paid the person who hit me cancelled my insurance

      I was in an accident Nov 16 2023. Usaa denied medical or Body Injury on my claim

    I have had a recent claim through them where it was denied and medical evidence proved it wrong. This is totally inappropriate. Please advise!!!

    USAA uses third-party contractors who make UNTRUE SERVICE / PROVIDER CLAIMS – claims for certain services they ARE UNABLE TO PROVIDE.
    This is fraudulent. Period.

    I have been going around for years with USAA. I have been relentlessly told that it went to a 3rd party arbitrator without notification and I cannot appeal their decision. I have even contacted the State Board of Insurance who said all cases were civil issues. Please add me!
