Uber background check class action lawsuit overview: 

  • Who: Damian R. Josefsberg filed a class action lawsuit against Uber Technologies Inc. and Checkr Inc. 
  • Why: Josefsberg claims Uber and Checkr fail to properly screen Uber drivers using stolen identities during pre-employment background checks. 
  • Where: The class action lawsuit was filed in Florida federal court. 

Uber Technologies outsources driver background checks to a company called Checkr that “consistently fails to properly screen the drivers or detect their use of stolen identities,” harming individuals with identities that have been stolen, a new class action lawsuit alleges. 

Plaintiff Damian R. Josefsberg claims Uber is responsible for individuals who have had their identities stolen by drivers working for the company who used stolen identities to wrongly pass background checks and identity verifications administered by Checkr.  

“Despite its claims that every driver must pass the background check and identity verification before being permitted to drive for Uber, many drivers use false information and stolen identities and become Uber drivers,” the Uber class action states. 

Josefsburg argues individuals who are victimized by Uber drivers that stole their identity to work for the company “are left with no choice but to deal with the consequences,” ultimately leading to financial harm. 

Uber, Checkr accused of failing to notify plaintiff before obtaining background report on him 

Further, Josefsberg claims Uber and Checkr failed to notify him before obtaining a background report on him —  as required by the Fair Credit Reporting Act (FCRA) — after his identity was stolen for an Uber driver background check. 

Josefsberg wants to represent a nationwide class of individuals or their legal representative who had their identity stolen — in violation of federal or Florida law — by an employee or contractor driving for Uber. 

Uber and Checkr are accused of negligence and of violating the FCRA and the Florida Deceptive and Unfair Trade Practices Act

In April, Uber agreed to pay $8.44 million to resolve claims the company wrongly classified its drivers as independent contractors rather than employees. Final approval for the class action settlement was granted in August.

    Uber has accuse me of having four accounts open that were deactivated and they all had very strange fraudulent email domains and they were Uber eats and one of them was used. I have been battling Uber since October 19, 2023. I was reactivated in November but I am still fighting this because I am finding out that there’s issues with my identity regarding Social Security and IRS. I got an message from Uber saying that they got the person who did it and they have been banned from the platform and that’s not acceptable because everything is pretty screwed up and for me right now I was deactivated for 49 days and then plus I can’t even file my taxes, verify with myself with the IRS, get a loan, and Social Security has no idea who I am

    After restrictions were removed from my license Uber and Checkr both refused to run to see corrections on the license. Many chats with Uber and all they do is say contact Checkr, all checkr says is to speak to Uber. Beyond frustrating. Images from the FLDMV, registration updates, insurance etc.. Basing on 2021 data which has not been updated since via UBER. I understand some drivers are not doing the right thing which we see are in the news but for those of us who have and are on the right track should not be punished for a clerical error Uber refuses to acknowledge.

    I signed up to drive for Uber and my account was immediately blocked. After finally talking to the right person it appears someone stole my identity and drover for Uber in 2021. I’ve sent Uber police report, pics with me and my drivers license, passport, and FTC report. It’s been “escalated “ for 3 weeks but still can’t get them to approve. Plus i want to talk to security department (which they say os impossible) so I know exactly what this person used of mine.

      Same here. I just found out yesterday. I have filed an FTC complaint as Uber only gave me an email address ending in “Uk”. I’ve never even heard of such an email address before!

    I was assaulted on a Uber ride, I launched a complaint and they did nothing but a 5.00 coupon on next ride

      the customer that reported avoiding traffic laws and my car doesn’t work. number one this guy was uP in age and he gave me harassment from the beginning of ride

    I have received 2 1099’s for the year 2022 for about $36,000.00. I have NEVER worked for Uber.

    Add Me Uber never notified me about background check until I received report from Checkr and I was let go through email
