Uber agreed to a $2.2 million class action lawsuit settlement with the United States Department of Justice (DOJ) to resolve claims under the Americans with Disabilities Act (ADA) that riders with a disability faced discrimination as the company charged them unfair wait fees.

The settlement benefits Uber users who opted into Uber’s wait time fees waiver program for riders with disabilities by May 12, 2022. 

Uber is a rideshare company that allows riders to request a ride between locations. According to Uber’s website, riders may be charged per-minute wait time fees if they don’t board a vehicle within two or five minutes of arrival, depending on the ride type.

The DOJ accused Uber of violating the ADA by charging wait time fees to consumers who took longer to board a vehicle due to their disability. Uber allegedly failed to provide a “reasonable modification” for these riders as required by the ADA.

Uber hasn’t admitted any wrongdoing but agreed to a $2.2 million class action settlement to resolve claims from the DOJ. This includes a $50,000 penalty paid to the United States.

“People with disabilities should not be made to feel like second-class citizens or punished because of their disability, which is exactly what Uber’s wait time fee policy did,” Assistant Attorney General Kristen Clarke of the Justice Department’s Civil Rights Division said in the DOJ’s settlement announcement

“This agreement sends a strong message that Uber and other ridesharing companies will be held accountable if their services discriminate against people with disabilities. The Civil Rights Division remains committed to enforcing the ADA and ensuring that people with disabilities can travel free from barriers and indignities.”

Under the terms of the Uber disability discrimination lawsuit settlement, class members can receive a credit to their Uber account. 

Of the Uber ADA lawsuit settlement fund, $1.7 million will be allocated to disabled rideshare users who have filed a complaint against Uber’s policies; $500,000 of the settlement fund will be used to compensate individuals identified by the DOJ as harmed by Uber’s practices. 

Exact account credits will vary but class members can receive twice the amount they were previously charged in wait time fees. 

Uber has agreed to make changes to its business policies as part of the ADA discrimination lawsuit settlement. The rideshare company agreed to maintain its notification campaign to inform users of its wait time fee waiver program and provide an accessible way for riders to request refunds for wait time fees. The wait time fee waiver program allows riders to certify that they have a disability and will waive fees for these consumers as an ADA accommodation.

In order to receive benefits under the Uber ADA discrimination class action lawsuit settlement, class members must submit a release of claim form by April 24, 2023.

    In late September of 22 I had really swollen legs health & disability reasons I needed extra assistance after I did a lil shopping after I got my meds at Walgreens pharmacy. My legs were SOOO heavy n exhausted so I ordered UBER ASSIST trusting that I was going to be safely assisted into there vehicle & SAFELY assisted to my door…. After having to wait at night for close to an hour to find THAT CERTIFIED UBER ASSIST DRIVER ( would’ve been worth it had I not been INJURED BADLY LIKE I WAS ) BROKEN FEMUR & LEFT HIP HAD TO GO INTO EMERGENCY SURGERY GOT METAL RODS N BOLTS NOW & BECAUSE OF MY HEALTH ISSUES I HAVE TO GO INTO SURGERY AGAIN CUZ IT HASNT HEALED & IEN’T been able to walk without a walker or wheelchair since…. Now I was trying to sue the driver or THE UBER ASSIST for not even attempting to get out of the car to assist me at all even after I fell from the curb straight to my knee and then to my face… Straight out of his mouth the only reason I got out of the car was CUZ I disappeared from the rear view monitor n he was in a hurry so he got out to look where I was… I was in tears broken glasses face had all kinds of scratches and gravel from the dirty gravel floor… NOT ONCE DID HE ASSIST ME UP OR ASSIST ME SAFELY
    ( he did grab my couple bags, etc. from my cart & put them over my body as I was trying to get myself up & slapping me with a bag ) remember he was in a hurry…. Then he just goes back into his car not assisting me still even after the fact…. Idk how 😭😢… All I no is didn’t even attempt to DO WHAT HE WAS PAID EXTRA & I HAD TO WAIT MUCH LONGER FOR… A CERTIFIED UBER ASSIST DRIVER…. IM NOT SAYING IT wouldn’t have happened if he would’ve did his job & at least got out to ASSIST ME 😭 WHO KNOWS MAYBE I WOULDNT BE SUFFERING IN so much PAIN every single day PAIN & UNABLE TO bear any weight what so ever on my left leg or been hospitalized for 3 months due to my complications of the SURGERY & with medical bills close to a million dollars…
    I DONT NO WHAT TO DO OR WHERE TO GO BUT I WASNT SUPPOSED TO BE BROKEN I PAID TO BE SAFE 😭😢😭😭 & ASSISTED 😭😢😭😢 HELP ME

    I have a few comments complaints outrageous that I need to express and hopefully somewhere out there will be able to help me first of all all about the Uber assist not only is it outrageous how long you have to wait to get one and I don’t know how many times I ordered the Uber assist and I was ready but I have like stairs to go down it just takes me a little longer than normal people because I have I have health issues and I get really really swollen legs and so it it’s difficult to walk fast so and I’m legally disabled through doctors and I don’t know how many times they left me because I was 2 minutes it’s either there and I go out my door and lock it up and and they’re just gone and then charge me and all that time I had to wait and they’re supposed to help when you order this cyst it’s like from door to door service they’re supposed to help you to the car safely that’s their motto safely not take off on you and and disappear and charge you and then make you wait another hour to get another assist to help you but they don’t help you I’m going to start a new one because I need to thank you

      My son told me just two weeks or so. The person that was driving told him u need to pay this then the driver told him just give me all ur money. Yes he’s disable my son said he cussed me out he said he was afaird. My son shouldn’t have to go through that. He wasn’t going far. That’s sad we have people treated that way. So idk how much he gave the driver.

    Add me. From the beginning Uber and Lyft didn’t know how to meet the different needs of disabled riders. Using a walker is still a nightmare because they don’t have to load it into the vehicle for you, per company policy. That’s B.S. imagine if you will that your wife took one of these rideshares with a cake she made on a covered pedestal and she also had a rolling duffel bag with bulky wrapped presents for donating to her churches toy drive and she gets picked up but, they won’t assist her with placing the duffel bag in the truck. She can enter the vehicle n fasten her seatbelt but lifting the duffel bag by the collapsible extended handle into the height of the truck is impossible and time is ticking. Imagine that you have a bulky walker that you need to not lose your balance and you have to lift it folded off the ground n place in truck without a free hand to hold yourself up. It takes longer to do everything and it doesn’t help to threaten someone with fees if you don’t move quickly, quickly to a disabled person is irrational, dangerous and potential can be fatal. No one should profit from charging a disabled person for taking too long to do anything.
