Rocket Mortgage overtime class action lawsuit overview: 

  • Who: A group of former Rocket Mortgage bankers filed a class action lawsuit against the mortgage loan company. 
  • Why: The ex-bankers claim the company fails to provide its workers with the correct overtime pay. 
  • Where: The class action lawsuit was filed in Arizona federal court. 

Rocket Mortgage failed to properly pay its bankers overtime for their hours worked in excess of 40 during a given workweek, a new class action lawsuit alleges. 

A group of former Rocket Mortgage bankers claims the mortgage loan company compensated them on an hourly basis but did not provide one-and-one-half-times their regular pay rate when legally required. 

The ex-Rocket Mortgage bankers argue the company’s alleged “unlawful failure to pay overtime” violates the Fair Labor Standards Act (FLSA)

“Under the FLSA, employers must pay all nonexempt employees one-and-one-half times their regular rates of pay for all time spent working in excess of 40 hours per workweek,” the Rocket Mortgage class action states. 

Rocket Mortgage fails to provide workers with correct overtime pay, class action claims

While Rocket Mortgage did provide some overtime pay, it failed to provide the correct amount since the company “improperly calculated Plaintiffs regular rate of pay pursuant to the FLSA,” the Rocket Mortgage class action alleges. 

“Defendant failed to properly incorporate the incentives, bonuses and additional compensation paid to Plaintiffs in each pay period as part of the determination of their regular rate of pay,” the Rocket Mortgage class action states.

The plaintiffs demand a jury trial and request declaratory relief along with an award of compensatory and liquidated damages for themselves and all class members. 

The former Rocket Mortgage bankers want to represent a nationwide class of current and former Rocket Mortgage brokers who worked more than 40 hours during a given work week but were not paid the proper overtime wage rate. 

A separate class action lawsuit was filed against Rocket Mortgage last January by a consumer arguing the company repeatedly sent marketing calls and texts to individuals who don’t want them and/or have their numbers listed on the National Do Not Call Registry.

    So many things to be said about this company. So glad someone is finally not afraid to take them on. All of the attorneys I reached out to were in their pockets or said “it was a conflict of interest”.

    I worked at rocket for 2 years and I had a feeling the pay was misleading. I was told to not even worry about the hours worked due to the commission I made. I was burnt out so I never bothered to look. I remember not having a day off during “March Madness” and thinking how wrong it was for them to make me work every day. There’s a lot I have to say about the company.

    I’ve been with Rocket for over 5 years now. I’d be curious to figure out the wages I lost. I’m upset because I went on a three month leave and I didn’t get paid for the loans I wrote before I left. It was over 9k in pay. They distrusted my loans to my team while I was gone.

    I was at Rocket from March 2021 til Dec 2022. And like the other bankers my OT was not paid out correctly. Please include me in this lawsuit. I’m due ALOT of OT money.

    At the height of the refinancing boom of 2020, I lost count on how hours I work. I worked so much it burned me out – I even had a SVP call me at 9:30pm on a Sunday asking me if I had “Another Folder” to submit.

    I remember seeing my first check when I hit the veteran floor and OT was $4 or something crazy. For whatever reason I just kept working more and more… pushing 60-70 hours a week. Their OT explanation known as “retro OT” was complete BS. When I had additional questions, I was always pushed to call the guy (in house term).

    I left RKT a couple months ago as a senior banker and our OT pay was half of our normal hourly rate. I never understood it, but just went along with it.

    Worked there and agree the OT was explained as Chinese OT. They did not pay us correctly.
