Rocket Mortgage overtime class action lawsuit overview:
- Who: A group of former Rocket Mortgage bankers filed a class action lawsuit against the mortgage loan company.

Rocket Mortgage failed to properly pay its bankers overtime for their hours worked in excess of 40 during a given workweek, a new class action lawsuit alleges.
A group of former Rocket Mortgage bankers claims the mortgage loan company compensated them on an hourly basis but did not provide one-and-one-half-times their regular pay rate when legally required.
The ex-Rocket Mortgage bankers argue the company’s alleged “unlawful failure to pay overtime” violates the Fair Labor Standards Act (FLSA).
“Under the FLSA, employers must pay all nonexempt employees one-and-one-half times their regular rates of pay for all time spent working in excess of 40 hours per workweek,” the Rocket Mortgage class action states.
Rocket Mortgage fails to provide workers with correct overtime pay, class action claims
While Rocket Mortgage did provide some overtime pay, it failed to provide the correct amount since the company “improperly calculated Plaintiffs regular rate of pay pursuant to the FLSA,” the Rocket Mortgage class action alleges.
“Defendant failed to properly incorporate the incentives, bonuses and additional compensation paid to Plaintiffs in each pay period as part of the determination of their regular rate of pay,” the Rocket Mortgage class action states.
The plaintiffs demand a jury trial and request declaratory relief along with an award of compensatory and liquidated damages for themselves and all class members.
The former Rocket Mortgage bankers want to represent a nationwide class of current and former Rocket Mortgage brokers who worked more than 40 hours during a given work week but were not paid the proper overtime wage rate.
A separate class action lawsuit was filed against Rocket Mortgage last January by a consumer arguing the company repeatedly sent marketing calls and texts to individuals who don’t want them and/or have their numbers listed on the National Do Not Call Registry.

Per the article, I would call “The plaintiffs are represented by James Weiler of Weiler Law PLLC. ” (1-480-442-3410) I would automatically assume since this is a federal case any previous banker from any state can join in the suit. I would reach out and inquire what is needed to join. Just take the roast out of the oven, lol
