Arm & Hammer Clean Burst class action lawsuit overview:
- Who: Akili Charles filed a class action lawsuit against Church & Dwight Co. Inc.
- Why: Charles claims Church & Dwight represents that its Arm & Hammer brand Clean Burst laundry detergent is environmentally friendly while allegedly failing to disclose that it contains a probable human carcinogen.
- Where: The class action lawsuit was filed in New York federal court.
Church & Dwight Co. “greenwashes” its Arm & Hammer brand Clean Burst laundry detergent to try and make the product appear more environmentally friendly than it actually is, a new class action lawsuit alleges.
Plaintiff Akili Charles claims Arm & Hammer Clean Burst laundry detergent contains 4.28 parts per million of the probable human carcinogen 1,4-Dioxane, despite it allegedly being marketed as environmentally friendly.
Charles argues Arm & Hammer designs the container for the Clean Burst laundry detergent with a blue wave and labels it “The Standard of Purity” while allegedly simultaneously failing to disclose the product contains dioxane.
“Despite the claim to purity, ‘Clean Burst’ and bright blue wave, nowhere on the packaging does it disclose the presence of dioxane,” the class action states.
Consumers ultimately end up paying a premium price for the Clean Burst laundry detergent, as a result of the “false and misleading representations,” the class action alleges.
Charles wants to represent a New York and multistate consumer fraud class of individuals who have purchased the Clean Burst laundry detergent during the statues of limitations.
Arm & Hammer Clean Burst laundry detergent can contaminate drinking water, says class action
Dioxane allegedly in Arm & Hammer Clean Burst laundry detergent — in addition to allegedly harming consumers — can also contaminate drinking water after the product is washed down the drain into “vulnerable aquifiers,” the class action alleges.
“While some water districts in New York have advanced membrane filtration and treatment capabilities to limit dioxane from polluting their water supplies, underprivileged and vulnerable communities, such as the elderly, children, and pregnant women, are at higher risks,” the Arm & Hammer class action states.
Charles claims Church & Dwight is guilty of fraud and unjust enrichment and of violating the Magnuson-Moss Warranty Act, several state consumer fraud acts and New York General Business Law.
Plaintiff is demanding a jury trial and requesting declaratory relief along with an award of monetary, statutory and/or punitive damages for herself and all class members.
A separate class action lawsuit was filed against Church & Dwight in June 2022 by a consumer arguing the company falsely advertised one of its Arm & Hammer laundry detergents as being able to do twice as many loads as another version of the product.
