close up of CBD oil droppersAccording to recent testing performed on CBD vape products by the Associated Press, many CBD oil products may be mislabeled. Many of these products contain little to no CBD, or are instead filled with opioids, synthetic marijuana, or other chemicals.

What is CBD Oil?

CBD, also known as cannabidiol, is a substance extracted from the cannabis plant. Unlike THC, which is also extracted from cannabis, CBD does not cause psychoactive effects or a feeling of being high. CBD oil is being researched for its possible uses as an anxiety and pain reducer.

CBD Products May Be Mislabeled

The Associated Press published the CBD report on September 16 after testing 30 samples of CBD vape products at a private lab.  The testing focused on how much CBD was present in each sample, as well as checking whether any of the 371 types of synthetic marijuana had been added. Ten of the 30 samples tested by the Associated Press contained synthetic marijuana. Additionally, out of the 28 CBD vape samples that were tested for the presence of CBD, eight contained no CBD at all.

The report also included results of testing conducted by law enforcement agencies on more than 350 CBD samples in Alabama, Georgia, Louisiana, Mississippi, North Carolina, Tennessee, Texas, Utah and Virginia. Of those 350 samples, 128 tested positive for synthetic marijuana, and three tested positive for fentanyl, a powerful opioid known for causing overdoses.

CBD mislabeling may be widespread. A 2017 study published in the Journal of the American Medical Association found that approximately 70 percent of CBD products were mislabeled, contained less CBD than advertised, or were contaminated with additional unlisted chemicals or drugs. Due to the risk of contamination, tampering, and mislabeling, the American Association of Poison Control Centers considers CBD to be an emerging hazard.

Consequences of Mislabeled CBD Products

Mislabeled CBD oil products can have serious consequences for consumers who ingest the products. One young man, Jay J., spoke to the Associated Press about going into a coma after smoking a CBD vape that contained added chemicals and drugs.

After taking two puffs from the Yolo! brand blueberry CBD vape, Jay claims that he began to experience terrifying side effects, including feeling like the nerves in his mouth were multiplied by 10, and seeing vivid images in his mind. He lost his ability to move and was rushed to the hospital by his friends, where he suffered acute respiratory failure and fell into a coma until the next day. According to victim reports, Yolo! CBD products have harmed at least 33 people in Utah, in addition to Jay.

Dozens of victims have wound up in emergency rooms after using vape pens and mislabeled CBD products that contain added chemicals and drugs. Despite the serious side effects of these altered products, regulators and drug enforcement agencies have not yet cracked down on the manufacturers. However, victims who have been harmed by mislabeled CBD oil products may be able to file their own class action lawsuits against the manufacturers and sellers of these products and pursue compensation for injuries and other side effects of the products.
