Sirius XM Radio Inc. violates New York law by making its subscriptions extremely difficult to cancel, according to a new SiriusXM lawsuit filed by New York Attorney General Letitia James.
New York-based SiriusXM reportedly has more than 34 million subscribers, and these subscriptions are automatically renewed at the end of each subscription term, the SiriusXM lawsuit explains.
“But once enrolled, Sirius continues to charge consumers unless they undergo a lengthy and burdensome endurance contest that Sirius created and implemented as a strategy for keeping as many consumers from cancelling as possible,” the SiriusXM lawsuit alleges.
“Even when consumers outlast Sirius and successfully complete the process, their subscription is not always cancelled.”
The SiriusXM subscription cancellation process allegedly requires consumers to interact with a live customer service agent and endure a “lengthy, six-part script” and multiple renewal offers. The SiriusXM agents are allegedly told not to accept “no” as an answer. Customers often get frustrated and give up before the cancellation request is processed, the complaint says.
SiriusXM lawsuit says company wastes customers’ time, fails to honor cancellations
Canceling a SiriusXM subscription wastes subscribers’ time even though the company has the ability to process SiriusXM subscription cancellation requests “with the click of a button” according to the complaint.
The SiriusXM customer agreement reportedly promises customers that they “may cancel their subscription at any time,” yet previous investigations into SiriusXM subscription cancellation processes reportedly found that the company fails to honor cancellations and makes it difficult to cancel subscriptions.
Frustrated customers have filed complaints with the New York attorney general’s office, the Federal Trade Commission and the Better Business Bureau, according to the SiriusXM lawsuit.
The SiriusXM subscription cancellation lawsuit asserts claims for fraud and various violations of New York law, including deceptive acts and practices, unlawful service offer practices and violations of the Restore Online Shoppers’ Confidence Act.
Earlier this year, SiriusXM was hit with a class action lawsuit alleging it fails to pay employees for pre- and post-shift work, depriving them of about 25 minutes of pay each day.

I had to call the 800 number to get them to cancel my subscription. The online link said my subscription was cancelled but I kept getting charged. When I called I had to threaten the csr with obtaining an attorney if they didn’t cancel the subscription. I got a nice f*** you before they hung up on me and had to call back.
I’m going through this ordeal now! So hard to get a live agent! I waited over an hour last time and gave up. Most services, you can cancel online, but they don’t allow it. Shady!
