Gopuff class action lawsuit overview: 

  • Who: Jonathan Beer filed a class action lawsuit against GoBrands Inc. 
  • Why: Beer claims GoBrands unlawfully automatically enrolls consumers who enroll in a free trial of its Gopuff online shopping and delivery service into a paid monthly subscription. 
  • Where: The class action lawsuit was filed in California federal court. 

GoBrands Inc. unlawfully automatically enrolls consumers who sign up for a free trial of its Gopuff online shopping and delivery service into a paid monthly subscription, a new class action lawsuit alleges. 

Plaintiff Jonathan Beer claims Gopuff does not provide “clear and conspicuous disclosures” nor does it “obtain affirmative consent” before enrolling consumers into its auto renewal plan for the monthly subscription. 

Beer argues consumers like himself are “being enrolled in this subscription plan in violation of California consumer protection laws,” namely its Automatic Renewal Law (ARL). 

“Consumers like Plaintiff are being enrolled in this subscription plan in violation of California consumer protection laws,” states the Gopuff class action. 

Beer wants to represent a California class of consumers who purchased a Gopuff Fam Subscription Program in the state. 

Gopuff allegedly violates law by automatically enrolling free trial users into paid monthly subscription

Consumers who sign up for a free trial of the Gopuff subscription program are automatically enrolled in the $5.95 per month plan following the end of the free trial period, according to the Gopuff class action.

Beer claims consumers “reasonably expect” that “they will not be enrolled in the paid program or charged” at the end of the free trial, instead “reasonably believing” that “they will only be charged if, following the trial, they decide to enroll in the paid service.” 

“But instead, Gopuff enrolls consumers in the paid service automatically at the end of the free trial, without clearly disclosing this fact to consumers,” states the Gopuff class action.

Beer claims Gopuff is in violation of California’s False Advertising Law, Consumers Legal Remedies Act, and Unfair Competition Law

Plaintiff is demanding a jury trial and requesting injunctive relief along with an award of restitution and other equitable relief for himself and all class members. 

A similar class action lawsuit was filed against HelloFresh last month by a consumer arguing the company unlawfully automatically renews customer subscriptions without providing proper notice

    I never sign up for GoPuff either and I’m going to file a lawsuit against them because they charged me $7.99 87 times over a period of 3 months I’ve tried getting a hold of their headquarters nothing so I’ve been talking to my lawyer and we’re going to court next month.

      I have a similar experience. I never signed up for this. Monthly started at 7.99, now it’s 8.09
      No way to contact them.

    I never signed up and they charge me $7.99 every chance they get. I cancelled the subscription that I never signed up for and they are still charging my card or try to anyway I keep it locked.

    I drove for go puff when they first started I encountered numerous things will that weren’t correct I wasn’t paid for over $200 of work on my last check before Christmas that I brought up to them the error and accounting and they basically just said well that’s our calculation and oh well like they have shorted me so many times they have so many laws broken against them I’ve been waiting for a settlement to come out against them how do I sign up I can’t find anywhere to actually sign up for the class action lawsuit for drivers can someone direct me thank you

    I have never heard of this company and they charged me 7.99. Then a subsidiary called gopuff charged me 32.00. They are ridiculous. I called them and they asked for banking info. NOT. They apparently already have it.

    I’m in Arizona and we started to sign up but never used it and they have charged me 7.99 TWICE once in December and once TODAY (1-10-2023)😡😡😡😡😡
