Hill Prescription Dog Food Class Action Seeks Damages

The recent Hill prescription dog food recall has prompted a class action lawsuit against the pet food manufacturer.

Hill’s dog foods are often recommended by veterinarians to help dog owners manage their pets’ health problems. However, some of these products may cause further health problems if they are part of a recent canned dog food recall.

In January 2019, Hill’s first initiated a recall of its canned, wet dog food due to concerns that the products contained too much vitamin D. This reportedly led to vitamin D toxicity in dogs that ate it.

Although vitamin D is a vital nutrient, too much vitamin D can cause serious health problems in dogs. According to a U.S. Food and Drug Administration (FDA) recall update, signs of vitamin D toxicity can include vomiting, loss of appetite, increased thirst, increased urination, excessive drooling, and weight loss. In severe cases, too much vitamin D can lead to kidney failure and death.

Hill expanded the recall in March 2019 and again in May 2019. The recall affects 86 lots of 36 varieties of both Science Diet and Prescription Diet canned dog foods. A full list of recalled products is available on the company’s website.

Hill Prescription Dog Food Class Action Lawsuit

Plaintiff Susanne Jacoby-Hale reportedly suffered damages due to her beloved dog’s illness. The animal reportedly got sick after Hale fed her pet Hill’s Prescription Diet i/d Digestive Care Chicken & Vegetable Stew Canned Dog Food daily for several years.

In March 2019, Hale’s dog allegedly started to experience vitamin D poisoning from eating Hill’s Prescription Diet dog food. Her pet allegedly experienced lack of appetite, diarrhea, blood in stool, vomiting, weight loss, and joint health. Hale says she the visits to the vet to treat her pet’s impacted her financially.

Jacoby-Hale’s dog food class action lawsuit claims that Hill’s Pet Nutrition Inc. failed to warn consumers about its dog foods’ risks, resulting in dogs becoming sick and dying. In addition to the dog owners’ emotional injuries, these consumers reportedly also sustained a financial injury by paying for their pets’ treatment.

“Hale was unaware that the Recalled Products contained excessive amounts of vitamin D at the time she purchased the products and fed them to her dog, due to the false and misleading claims and warranties made by Defendants on the labels and packaging,” the Hill’s dog food class action lawsuit claims.

“Hale would not have bought the Recalled Products, or fed them to her dog, had she known that they contained excessive amounts of vitamin D.”

Hale seeks to represent a Class of consumers who purchased the recalled Hill prescription dog food products and suffered damages as a result. She also seeks to represent two subclasses of consumers from Florida and New York, respectively.
