Walmart app on phoneA class action lawsuit claims that Walmart misleads consumers by advertising prices on its online app that are lower than those offered in stores.

Plaintiff Sofia Maynez says she used Walmart’s app to view prices of items, which she then purchased in-store.

According to the Walmart class action, she viewed Huggies Wipes as advertised for $5.44 on the Walmart app, and Huggies Pull Ups advertised at $8.97 on the app. 

However, when the plaintiff says that when she went to purchase the items in-store, she paid $12.54 for the Huggies Wipes, and $31.84 for the Huggies Pull Ups.

According to Maynez, she paid $29.97 more for the two items in-store than she would have if they were sold for the prices offered on the Walmart app.

The Walmart class action says the retail giant makes a widespread practice of misrepresenting prices on its app. The plaintiff states that this practice violates California law including the Unfair Competition Law, the Consumer Legal Remedies Act, and the False Advertising Law.

Maynez seeks damages on behalf of herself and all other similarly affected consumers around the country who, in the last four years, used Walmart’s e-commerce app, found a quoted price, and then purchased the same item at a store for a price higher than that advertised on the app at the time of their purchase.

Additionally, she hopes to represent an Injunctive Relief Class of those consumers who saw a price on the app, but were offered the item at a higher price in-store, even if they did not purchase the item.

She seeks for Walmart to be required to disgorge all profits gained from wrongfully representing prices to entice consumers into making purchases. She also wants damages on behalf of herself and all consumers allegedly injured by Walmart’s conduct.

The Walmart pricing class action lawsuit asserts that Walmart knew that its online prices were lower than the in-store prices, and made them inconsistent in an act of “fraud, malice, and conscious disregard” for the rights of its consumers. 

Allegedly, Walmart intentionally misled its consumers in the interest of its own profits, knowing consumers would be enticed by the low prices represented on the app.

According to the Walmart app pricing class action lawsuit, the company was unjustly enriched by its misrepresentation of online and in-store prices, at the expense of its unknowing consumers.

    This happens all the time! I find it ridiculous that they wont match the price in their own walmart app! It is false advertisement, I am glad someone is taking action, maybe we’ll see a change.

    I was at Walmart store #00769 in Venice Florida on 02/05/2022 to purchase a birthday gift for my granddaughter. I found a toy called Hatchimals Pixies Crystal Flyers Starlight Flyer on the shelf with no price, I used the Walmart app to get a price check and scanned the item which came up as $23.99 and it also shown that it was on Aisle I31 in store. After shopping more I went to the self checkout and the price for the Hatchimal came up as $34.97. I called the lady working there and she scanned it on the Walmart scanner she carries and it came up also as $34.99m. I scanned the Hatchimal barcode again and showed that it’s on aisle I31 and it’s supposed to be $23.99. She called the assistant manager and that lady said there was nothing she could do. I went through the whole process again and scanned it for her and the store price is supposed to be the $23.99 and insisted that she give it to me for that lower price. She got aggressive with me and threw her arms up and yelled go ahead and give it to him at the lower price. After paying for everything left and decided to call the store manager named Jay on my receipt, It took 6 times calling to talk to a store manager after being hung up on 5 times. Walmart removed the scanners that where in the store for customers to price check and we are supposed to use the app. Just think how many people don’t check what they were really charged for an item, Walmart is making millions doing this dishonest practice.

      This exact same scenario happened to me today at the Defiance, Ohio Walmart. I was purchasing a Polly Pocket dolphin beach toy for my daughter that we found on a random shelf. The Walmart app price checker said $11.99 aisle N5 but when I got to the register it rang up as $15.99. I had to talk to multiple associates before the price was changed for me.

      If all would stop shopping at Wal-Mart because of false advertising Wal-Mart would have to change it’s online practices or loose millions in revenue

      Thats so true. Happened twice. Saved 62$ in total, they can do anything with the system if they will to and not throw tantrums, i just bought my son a book said on shelf for 14$ the counter lady scanned for 10$ where as in my app it was on sale for 4$ !!! When i showed her my price she immidiately changed it to 4$ 😥

    Happens all the time. I take screenshots and try to get a price adjustment, but get told that there’s nothing they can do.

    This past week 3 times at Walmart the prices have not matched what rings up. 2 items were within a few dollars difference but one scanned 11.87 on app and rang up 19.97. this is ridiculous and alot of people don’t pay attention to prices when ringing up so there is alot of scamming going on . Almost seems this new app was made to do this .

    I worked for Wal-Mart 30 plus years ago and had the pleasure of meeting Mr. Walton. He visited our store in Orlando #1220 and from his speech and the ethics of the store Im sure this is not at all the way he intended the company to conduct business.
    Im a new small business, been opened for a little over 2 years, watching my budget is so important. I use WALMART APP and Set my local store . The app has a price checker, it shows the availability of product and the purchase options. PICKUP, SHIP, DELIVERY OR My Favorite, SHOP INSTORE (THEY ALSO GIVE ISLE NUMBER). So I was thrilled to find Cricut Every Day Iron On at what I would call a clearance price.
    Like everyone else here the price was twice as much at check out
    Here is what I want every one to know, HAD THE CSM TREATED ME LIKE A VALUED CUSTOMER AND NOT A STUPID IDIOT I wouldn’t be here. He acted if I was doing something wrong and tried to get over on them, If I wanted at that price I should shop online.
    But its instore price checker I said. He said, “yes for online”
    I then said “so the shop instore price checker that gives me the isle number to purchase instore myself item is for what?”
    I left without item.
    I was shaken, upset due to the confrontation the young man seemed to enjoy, this is our families home store and I was reprimanded my a young man IN front of over twenty customers corralled in self checkout. I was not rude, snide or even bitchy. I was genuinely asking a legitimate question.
    Maybe he was busy, bad day however I never want to step foot in the store again. Humiliated, I feel like I was and who ever else uses the app (Advertisement encourage us to use) are being scammed.
    I did return to store today to get the information on how purchase the item at said price.
    This CSM said (“no problem, to purchase at this price I had to purchase online with the 3rd arty seller”) This just gets better and better..
    I show her the only party that was adervising this price was this store on this isle. There was no THIS PRODUCT IS ALSO AVAILABLE FOR SHIPPING BY ECT…”
    She then said “Ive been here 18years and dont understand all this NEW SHIT they got going on”
    “All I know is we cant give it to you, you have to shop online”
    I purchased the items at twice the amount that was and still is being offered instore.
    This is just wrong. I could have, I should have ordered on Amazon like usual in business account but the price was unbeatable and it was trustworthy, it was IN STORE, THERE WERE X AMOUT AVAILABLE, AND THEY ARE LOCATED ON ISLE F27.
    Walmart has lost My Trust, left me overwhelmed, fretting about how I’m going to raise my kids, keep the business going. We live in a small town and Walmart is our only Bix Box Store,, I rely on them for almost everything for my household, Amazon for business. Now what. Ethically? I wont give them another dime of my money.

      Searching for a tire with Walmart automotive online I found the tire I needed I called my roadside assistance that took me two days to get there because of being a weekend or holiday I searched again to make sure the tire was in stock and I called the store to make sure it was in stock everything was good I told him I was coming in on a toe in between the conversations when I got you Walmart automotive I was told I had to buy two tires being that one was a different tire from the other I didn’t have the money to do this but I thought you know what whatever then I was told I had to buy boats because mine was missing one boat I’m on flat the tow service at done drop me off an hour and a half before I had to pay a customer $40 to take me to an automotive store there and back on a Sunday when I get back to the store the man told me that the manager told me about it that he could not change my tire because he did not have one in stock me and the woman cashier and automotive had just recently looked at the tire on the aisle I said you had to fix his tires and tow so I was dropped me off at this Sunday it’s not another tire service open in Texarkana at that hour it was going on for 4:30 then in the afternoon they did nothing except throw my bolts and lugs into my passenger seat a later lunch I only needed one boat not the four that they had told me I needed well they had told Ashley AutoZone I needed when they called to make sure they was getting the correct boat in Love The Mail Manager once again said she needs four not one when I went to put on the legs through a tire shop I only needed one like a nut the same one I thought I had seen before and no choice but to leave the Walmart on New Boston road in Texarkana Texas and head toward summerhill road hoping to find a tire shop along the way on a flat back tire but time I got your new Boston and summerhill road the tire was shredded and people were waving me down the tire shop just before that had closed I couldn’t talk so I’m heading home on summerhill and 7th Street the one way and I realized I had no choice but to stop I’ve now driving on the wheel itself there was barely rubber left a friend had to strip the tire off and I yet had to go pay for the tire on the Arkansas side they went there send me one over they couldn’t do that oh no and then I had to pay the man that get the tire for me his yard $20 I had to pay the man that took me to get the charge 20 dollars and I had to pay the other man that help me put it back on because the first man was gone $10 I left his house crying only a few months before that and bought my car and paid for it for two days in cash Walmart my battery and broke my car up I’ve struggled ever since losing a job or the possibility of new work they treat me different now and then one man just not the upper managers were talking about the Walmart automotive manager the lady behind the counter she’s real sweet there has to be Justice somewhere this cost me an awful lot of money embarrassment and I went right back to square one coming home all money I had
      Cash I paid for the automobile and what I was returned in from Walmart was half the cost I lost half the price of the car I had bought that they burn up the second car I got the flat it’s nothing as good as the first one I bought from a person that wasn’t fully honest and he refuses to contact me now my car is still not legal the second car and there’s more issues than way more issues than what I thought I’m fixing to be without a vehicle at the age of 60 I’ll suffer from an illness that requires me to go to the doctor often I do not ride public transportation from my illness there are great people that works for Walmart and there are some the act as if we are a nuisance to their day nuisance to their day if you don’t want to work for Walmart and treat customers decently get another job God bless everyone I forgive everyone and thank you for reading

    This exact thing just happened to me. It is malicious, dishonest, and a money scheme. I went into Walmart to by a few elf on a shelf surprises for my kids in the morning and a tooth fairy gift. My daughter lost her first tooth. I spent over an hour trying to find the right surprises. I also have to be very cautious of money these days so I was checking the prices as I shopped with the app. It tends to be a mess on the shelves right after Black Friday and it was obvious that toys were not all stocked correctly so I was using the app to help me figure out prices to keep within my budget. When I got to self checkout multiple items where well over the app price. An lol doll surprise rang up for $10.97 when app scanned $7.12. A fur real rang up for $11.82 when app scanned $8.27. They were refusing to match the price and told me that it was an instore tomorrow pick up order price. They insisted that I had to order online an pick up next day. I told them to put my entire basket of things up than. The whole reason I was their was to get my children’s surprises for un the morning and if I can’t do it tonight than it was a waste of time. The manager finally decided to match the price because she could see how distraught I was. The app scanner is highly inaccurate to many in store items even though you scan them right in the store.

    All the time. They are supposed to honor the online price but will refuse. It just happened to me. I bought my daughter a book and it rang up 4.87 online and it showed it was in the store too it was 3.81. The cashier refused to honor it. I know it is only a $1 and change but it happens all of the time.

    This happened to me yet again today. Need a remote for my Samsung sound bar found one on Amazon for six bucks but thought let me check the Walmart app since I needed groceries anyway and they had a ge universal Remote pre-programmed for Samsung devices for $8.13. I thought OK 2 bux more but don’t have to wait a few days for shipping I’ll grab it. Got that and a few groceries and other things. Didn’t notice the price when it was scanned but once I got home and looked at the receipt I was charged $15.82. They bank on situations like this where I didn’t notice or someone saying screw it I already drove here why not if they did see the higher price. No more for me; going to order the six dollar Amazon one open this one up and use it until the Amazon one gets here then going to return the Walmart one with a smile. If theyre gonna screw me, Im gonna screw right back…

    We have also found a new class action law suit that should go forward. Today, I put $4.97 of Tide pods i my cart. A few hours later they had switcheded me to 21.99.Shipped Tide pods, the same exact item. The original item is still in the store available for pickup at the original price. Plus if I had not caught the “BAIT and SWITCH Price” I would need to pay shipping also! Anybosy with me on aother Class Action suit? Not sure how to start one, but I can probably find out from GOOGLE. LOL
