Walmart app on phoneA class action lawsuit claims that Walmart misleads consumers by advertising prices on its online app that are lower than those offered in stores.

Plaintiff Sofia Maynez says she used Walmart’s app to view prices of items, which she then purchased in-store.

According to the Walmart class action, she viewed Huggies Wipes as advertised for $5.44 on the Walmart app, and Huggies Pull Ups advertised at $8.97 on the app. 

However, when the plaintiff says that when she went to purchase the items in-store, she paid $12.54 for the Huggies Wipes, and $31.84 for the Huggies Pull Ups.

According to Maynez, she paid $29.97 more for the two items in-store than she would have if they were sold for the prices offered on the Walmart app.

The Walmart class action says the retail giant makes a widespread practice of misrepresenting prices on its app. The plaintiff states that this practice violates California law including the Unfair Competition Law, the Consumer Legal Remedies Act, and the False Advertising Law.

Maynez seeks damages on behalf of herself and all other similarly affected consumers around the country who, in the last four years, used Walmart’s e-commerce app, found a quoted price, and then purchased the same item at a store for a price higher than that advertised on the app at the time of their purchase.

Additionally, she hopes to represent an Injunctive Relief Class of those consumers who saw a price on the app, but were offered the item at a higher price in-store, even if they did not purchase the item.

She seeks for Walmart to be required to disgorge all profits gained from wrongfully representing prices to entice consumers into making purchases. She also wants damages on behalf of herself and all consumers allegedly injured by Walmart’s conduct.

The Walmart pricing class action lawsuit asserts that Walmart knew that its online prices were lower than the in-store prices, and made them inconsistent in an act of “fraud, malice, and conscious disregard” for the rights of its consumers. 

Allegedly, Walmart intentionally misled its consumers in the interest of its own profits, knowing consumers would be enticed by the low prices represented on the app.

According to the Walmart app pricing class action lawsuit, the company was unjustly enriched by its misrepresentation of online and in-store prices, at the expense of its unknowing consumers.

    I tried doing ron order to pick up on the walmart app but the items I were looking for was only available in stores. The sandals were advertised on the app for only a dollar, a bath towel for my toddler was advertised the same and when i went in-store the sandals were 5.88 and the towels was 10.00! After packing up my 2 small children and going to store specifically for these and a few other items marked as being on big clearance I was Suppossed to spend only 38.00 and spent well over 80. Had i known it was going to be such a difference I would have gone to target where the items were cheaper and i could have gotten curbside pick up. I wasnt aware they were doing this. I did notice the price changed on the app as soon as i got to the store.

      The same thing happen to me. Found items marked down went to Walmart to purchase, everything on my Walmart app in my cart disappeared. Everything I scanned showed full price not sale price. It’s like Walmart took over my phone. Also my Walmart app says Beta which is different from my daughters Walmart app, mine shows no clearance prices or where you can go to find the item at a different store.

    Go to a Target that will match competitors prices and show them what Walmart has it listed for in their app. As long as the Walmart store location shown in the app is local and the app says it’s in stock then Target should match their price. Walmart will never match the prices they show, so outsmart both retailers!

    This happened to me today. 3/5/2021. On the app it showed that the sweet love baby dolls 4 piece Set were $0.50. When I got to the register I told the cashier then she was like oh that’s only for online when it said for in store purchase. Then she got another lady who was like no it’s 11 something dollars that’s what it scans and that the manager said that’s the price. What’s the point of even downloading the app if they won’t even honor the price on the app. ??‍♀️

      I cant tell you how many times that has happened to me. It makes my life blood boil! Ive written to Walmart, Asking them, Why they even have an app, When it is worthless! And when your in the store trying to get an answer out of an employee, all you get is, Sorry, but it’s not that price, or Sorry we dont have that item. You just get the run around, They just lie to get you into the store thinking you’ll end up spending money on something while your there. They need to be stopped. It cost’s us money in gas getting to the store, And time, Just to end up leaving the store pissed off once again!!

      Same here go in to Walmart get the item rings up different price manager refuses to price match I call Walmart main office am told it’s up to each manager if they price match or not and that I should contact the Walmart.com

      I would like to join too. I have photo evidence that they are changing prices. They advertise on Google a certain price and when you click on it it shows you what store has it for that price. And then when you go to that store and you show them that I’m walmart.com it’s saying at that location they are selling this item for this price they refuse to honor it. They say it’s not our problem it’s a walmart.com problem. So then I call walmart.com they keep claiming they can’t see it but yet I’m able to pull it up easy on my side I took screenshots and sent it to them not one or two times but seven times total they keep saying that they’re not getting my screenshots. Then they keep saying sometimes the ads differ on Google then they are on Walmart.com. Only get your prices from walmart.com. Funny that never happens with Target and secondly it was on Walmart.com when you clicked on the ad when you choose the store it clearly shows you the price at that particular store. What it is it’s a bait-and-switch they trick you one of their stores to shop and when you get there most people just say screw it and put the item back and then get the rest of the stuff that they have in their cart. They need to get in trouble for this

    This has happened to me multiple times. I always search the pp before I go in to purchase things as I have young children. The price is normally always changed back to full price.

    Happened to me today 1/3/21 at 4208 S Pleasant Crossing Blvd, Rogers, AR 72758. Wal-Mart app showed 25′ onn. Hdmi cord marked down from $12.98 to 10 cents. Talked to 2 managers who bothed refused to price match. Neither could give a valid reason as to why. Called customer service and he looked up the price on his phone and confirmed that the in-store price on the app was in fact 10 cents. He told me I’d receive a follow up call from the Store Manager within 3-5 business days.

      I have been looking for toy story action figures that have been sold out. I found them tonight 2.11.21 but they were over an hour drive away. They were 32.88 marked down to 3.50, but it was in store purchase only. I called the store to make sure it was accurate and in stock. I loaded up my 2 year old and 1 year old and got one of each for all 3 of my boys. I got to the register and they wouldn’t honor it. I showed them the add, and how it rang up on my phone and they told me they wouldn’t honor it. They would not give me a reason. I told them it was illegal for them to charge more, but they told me sorry. I asked to speak to the manager. They pulled 3 different people over and no one could tell me why. They said they had the issues the prior day and the store manager said not to honor it. I explained I had driven over an hour and my boys were so excited and begging me to let them have the action figures. They were so rude and I left with my boys screaming and crying because I had promised they could have them. They didn’t understand why they were leaving empty handed. I called another Walmart and they said they had never heard of such and to call a -800 number. I did and the only thing he could say was he didn’t understand and it didn’t make any sense but he was emailing the store manager and he had 3 days to respond. If I would have done my job the way the employees did theirs and treated people that way, I would have been fired. I’m so angry and disappointed by the mistreatment and rudeness. I think they should be sued and those people should be fired.

    This has happened to me several times, including this evening. A CSM was there as the cashier was scanning the items and I stopped her when I saw the wrong price and I scanned the item with my app. The CSM scanned the item on her handheld and saw the price that I did. However, she stated if she cannot add it to her cart, she will not honor it. That would be reasonable if you weren’t trying to add something that stated it was an in store purchase only. It just wasn’t worth the argument I knew I would lose, so I left all three items.

    Just happened to me and my wife at 2 different wal marts we scanned a the pioneer woman cookware set with the wal mart store assistant its showed 21.00 dollars went to check out came up 79.00 at the register. It was 3 dollars on the app but at register it show full price this was at the middletown ky wal mart and the Frankfort ky wal mart.

    It happened to me. When I showed the assistant manager my phone with the Walmart app she very rudely said we do not go off of what the customers phone say. I said I’m on the Walmart app, the manager said we can only use our handheld devices and if the price rings up for that, then that’s the price.

      This happens to me on the daily cuz I shop there all the time and I see prices for LOL omg dolls on app for example $5 then I get to the store and its $26.99 this happens to me all the time its not right and they should fix the problem.

        This happened to me a few times within the past couple of weeks. They have removed in store price checkers so we only have the app to rely. Fill your basket and get embarrassed at checkout. Unacceptable Walmart!

      Yes we are experiencing the same thing here in New York they refuse to sell us items that are for sale at a lower price in one store so we travel there to save money then leave empty handed after being talked to like complete garbage in front of everyone usually three employees at register during this time also trying to figure it out then managers refuse to sell the item for their own price it’s not a price match to online or any other retailer it’s that specific stores listed price on the app.
