Walmart app on phoneA class action lawsuit claims that Walmart misleads consumers by advertising prices on its online app that are lower than those offered in stores.

Plaintiff Sofia Maynez says she used Walmart’s app to view prices of items, which she then purchased in-store.

According to the Walmart class action, she viewed Huggies Wipes as advertised for $5.44 on the Walmart app, and Huggies Pull Ups advertised at $8.97 on the app. 

However, when the plaintiff says that when she went to purchase the items in-store, she paid $12.54 for the Huggies Wipes, and $31.84 for the Huggies Pull Ups.

According to Maynez, she paid $29.97 more for the two items in-store than she would have if they were sold for the prices offered on the Walmart app.

The Walmart class action says the retail giant makes a widespread practice of misrepresenting prices on its app. The plaintiff states that this practice violates California law including the Unfair Competition Law, the Consumer Legal Remedies Act, and the False Advertising Law.

Maynez seeks damages on behalf of herself and all other similarly affected consumers around the country who, in the last four years, used Walmart’s e-commerce app, found a quoted price, and then purchased the same item at a store for a price higher than that advertised on the app at the time of their purchase.

Additionally, she hopes to represent an Injunctive Relief Class of those consumers who saw a price on the app, but were offered the item at a higher price in-store, even if they did not purchase the item.

She seeks for Walmart to be required to disgorge all profits gained from wrongfully representing prices to entice consumers into making purchases. She also wants damages on behalf of herself and all consumers allegedly injured by Walmart’s conduct.

The Walmart pricing class action lawsuit asserts that Walmart knew that its online prices were lower than the in-store prices, and made them inconsistent in an act of “fraud, malice, and conscious disregard” for the rights of its consumers. 

Allegedly, Walmart intentionally misled its consumers in the interest of its own profits, knowing consumers would be enticed by the low prices represented on the app.

According to the Walmart app pricing class action lawsuit, the company was unjustly enriched by its misrepresentation of online and in-store prices, at the expense of its unknowing consumers.

    Just left Walmart, walked away from my cat with Bella plastic totes with lids. 1.00 on the app. Over $9.00 in the store! The gals tried to say the app said they were OUT OF STOCK online. Well, I told them they were INSTOCK at this Walmart! This went back and forth a few times. I asked if they could show me this policy, in writing. Nope. Well, this has happened to me before too. If there are 192 pages of complaints about this IT’S A PROBLEM! I’m in Kansas. We have BAIT AND SWITCH LAWS in this state. SIGN ME UO FOR THIS CLASS ACTION LAWSUIT!!

    Yes, infact this exact thing happened to me today. 6/24/21. When I called customer service she told me there was nothing they can do. Half of all the prices were very low. Almost nothing matched. Something needs to be done immediately! They wasted my time today.

    Happened to me in AZ 6/14/21. And they had the nerve to change the price after i went back and forth. Advertised an apple 6 watch at $359 in app. Was connected to their store wifi. App gives location price and they refused to honor it. $379 rang up at register. This happens to me all the time. This time it was for more than $2. This is fraud.

    Yes this happens to me so many times I’ve lost count. I see something on the Walmart app for a certain price go to Walmart for that specific item because it says they have it in stock only to get to the reg and have it ring up full price and they won’t honor the price it shows on the Walmart app. The most recent was the Sweet Love baby doll 4 piece set was showing $0.50 on app and showed in stock. I hurried got around drove to Walmart the dolls were in the aisle it showed on the app so I scanned it with my phone under the Walmart app and it showed $0.50. Took the 6 they had on the shelf and went to the reg only to have it ring up full price. Went over got a CSM explained what was going on and she tells me no their full price. Yes please add me!

      I found those same dolls- 2 were in some random area, so I scanned them, $0.50 at the specific store I was at, register rang full price- showed manager the app said they were $0.50 at that store. She told me I could only purchase 1 at the $0.50 price as there was a “glitch” in the app. However, I do understand when their online prices are different than in store (for web based purchase vs in store-if you look up your store and it says for that store it’s a certain price and rings up different, that’s a problem; but if the price is for an online purchase and differs, that’s a non-issue) as they are trying to get business online… the stores here haven’t price matched in years (to anywhere)

    WalMart claims to do price match too but they won’t match there online prices I’m so frustrated with them

    I buy a 30 lb of Friskies dry cat food.
    Wal-Mart online app same one I save my receipts to.

    Online price $20.12 available for pickup today with the Aisle # were product is in store.
    When I go to the same store as stated In charged $ 21.12. This has been going on for 1 1/2 years same pricing. I buy 1 bag every 2 weeks.
    I’ve brought it to there attention and all they say is manager won’t allow.
    NOTE.
    When I upload my receipts to my history on same app. When I tap on my purchased item it comes up 20.12. $1 cheaper then what my receipts shows.

    Also this same walmart at the store location.
    There 1 gallon store value brand Milk. Has a $ 3.00 price display.
    When it rings up at $3.07 has been going on for atleast 2 months.. Have told them about the mistakes price . nothing done.
    Ok yes its only .07 cents more but it’s that fact that’s not what the price states. That’s false.
    So please add me to this class action.

    This is happening to me now. Violates three California law
    1. Unfair Competition Law,
    2. Consumer Legal Remedies Act
    3. False Advertising Law.

    The price listed for Gerber 4 pack onsies are $1.00 sale in store purchase only. I drove to walmart however in-store the price listed is $7.95. I went to customer service and they could not honor this misleading price. This is wrongfully representing prices to entice consumers to visit in store purchase.

    So I see Walmart advertise in their app .03 cent video games but every time I try to buy them they won’t sell them to me in the store. Constantly happens

      The return stickers when you come in the store and get used to say .03 cents since its not actually a price tag it was a tag to let the associates know you walked in the door with it. If they did the real price you could just take the tag from the shelf and say you came in with it when you didn’t. Unless packaging or barcode got damaged they don’t use pricing labels on the item and that should be pretty common knowledge and just common sense.
