NFL App Class Action Lawsuit Overview: 

  • Who: An Android owner kicked off a class action lawsuit against NFL Enterprises LLC. 
  • Why: The plaintiff claims NFL Enterprises unlawfully shared personally identifiable information of NFL App users with unrelated third parties, namely Google.
  • Where: The class action lawsuit was lodged in Rhode Island federal court.

Android owners who used the NFL App had their personally identifiable information (PII) unlawfully passed on to Google, a new class action lawsuit alleges. 

Plaintiff Daniel Louth claims NFL Enterprises — which owns and operates the NFL App — knowingly discloses users PII, such as a record of video clips viewed and location, to API Anvato, Google’s marketing apparatus. 

Louth wants to represent a nationwide Class and a Rhode Island subclass of consumers who used the NFL App with location services enabled in order to watch videos and had their PII transmitted to a third party.

NFL App Users Not Told That Their Info Sent to Google

Louth says he downloaded the NFL App and enabled location services on his Android phone so that he could watch NFL games and video clips, however, he claims he never consented or was given an option to prevent having his PII shared. 

“Nevertheless, each time Plaintiff viewed a video clip using the NFL App, Defendant disclosed his PII—in the form of the URL, title, and short descriptions of the videos he had watched, his unique Adverting ID, and his GPS coordinates,” states the class action lawsuit.

Louth’s information was sent to API Anvato, Google’s marketing apparatus, according to the class action lawsuit, which claims Google was able to use the information to identify Louth in its own databases. 

Louth argues NFL Enterprises’ actions put it in violation of the Video Privacy Protection Act and the Rhode Island Video, Audio, and Publications Rentals Privacy Act. 

Plaintiff is demanding a jury trial and requesting relief in the form of statutory and putative damages for himself and all Class Members. 

A similar class action lawsuit was filed in 2014 by WatchESPN app users who alleged the sports network unlawfully disclosed the private information of app users to Adobe Systems Inc

Google has fought multiple legal battles over privacy concerns, including a class action lawsuit alleging Google illegally tracked Internet and video viewing activity of minors.
