A bedding consumer is suing Macy’s alleging the retail giant falsely markets its Oake brand bedding as being 100% cotton.

Plaintiff Anna Stock filed the class action against Macy’s Merchandising Group Inc. and Macy’s Inc. on June 27 in a California federal court, alleging violations of state and federal consumer laws.

According to the lawsuit, Macy’s uses false and deceptive practices in the labeling, marketing and sale of its Oake brand “100% Cotton” comforters, coverlets, quilts, duvets and shams.

The plaintiff alleges the front label of the products prominently states the products are “100% Cotton,” indicating that they are made solely with cotton.

“Unbeknownst to consumers however, the Products are not ‘100% Cotton’ because they contain polyester filling. Indeed, only the cover of the Products is made with cotton,” the lawsuit states.

Consumers paid a premium for the bedding, lawsuit alleges

Stock alleges she and others paid a premium price based upon their reliance on the front label representation that the products are cotton.

“Had Plaintiff and Class members been aware that the Products are not ‘100% Cotton,’ Plaintiff and Class members would not have purchased the Products or would have paid significantly less for them,” she says.

Stock says Macy’s other private label brands, such as Charter Club and Hotel Collection, accurately label their bedding products, but Macy’s has chosen not to do the same for the Oake brand.

As a result, she is looking to sue Macy’s for violations of California consumer and advertising laws, breach of warranty and unjust enrichment. She is seeking certification of the class action, damages, fees, costs and a jury trial. 

Meanwhile, earlier this year, a class of buyers who claim Macy’s Inc. and Macy’s Stores West Inc. misled them about the thread count of its cotton-polyester bed sheets asked an Ohio federal judge to approve a $10 million settlement with the retailers.
