Roundup settlement overview: 

  • Who: New York Attorney General Letitia James’ office led an investigation into Bayer CropScience LP and the Monsanto Co. related to its Roundup pesticide products.  
  • Why: Monsanto had a 1996 agreement to not advertise the environmental safety of its Roundup products without proving those claims.
  • Where: The settlement is filed in New York by the Attorney General Environmental Protection Bureau.

Bayer CropScience LP and the Monsanto Co. have agreed to a $6.9 million settlement with the state of New York over violations of its 1996 legal agreement with the state to discontinue advertising that Roundup products are safe for the environment without being able to prove such claims.

The funds will be sent to the state and held to be “used to prevent, abate, restore, mitigate, or control prior or ongoing water, land, or air pollution affecting pollinators, threatened or endangered aquatic species, and their habitat, including but not limited to, habitat management, restoration, and enhancement, as well as pollinator research, monitoring, education, and outreach, as further detailed in the 2020 New York State Pollinator Protection Plan Update,” according to the Roundup New York settlement.

The company has agreed to remove all of the items that violate the previous agreement, including YouTube videos and websites that claim the ingredients in Roundup are as safe as shampoo or dish soap, according to the Roundup settlement.

Several studies have shown glyphosate, found in Roundup, is dangerous to honey bees, damaging their gut microbiota, and also may “affect honey bee fitness, including harmful sublethal impacts such as negatively affecting learning performance, reducing short-term memory, and causing navigational issues resulting in increased time and pathing of homeward flight.”

Bayer CropScience, Monsanto agree to pay $100K if they violate the agreement in the future

If Bayer CropScience LP or Monsanto violate the settlement agreement in the future, they agree to pay $100,000 per instance for any occurrence after the settlement agreement is completed.

Monsanto previously agreed to pay up to $45 million as part of a class action settlement resolving false advertising and breach-of-warranty claims surrounding certain Roundup®, HDX® and Ace® weed and grass killer products.
