Bob’s Discount Furniture Goof Proof class action overview: 

  • Who: A Bob’s Discount Furniture customers is suing the company over its Goof Proof insurance policy
  • Why: The customer says Bob’s does not pay out insurance on its furniture when it should

Bob’s Discount Furniture often denies insurance claims for its Goof Proof insurance, even when the damage is clearly covered under the policy, a new class action lawsuit alleges. 

Plaintiff Kenneth Wong filed the class action lawsuit against Bob’s Discount Furniture LLC June 20 in a California federal court, alleging violations of state and federal consumer laws. 

He said the company sells furniture with added protection plans known as “Goof Proof” which is marketed as “the best way to protect your investment from a wide variety of accidents for 5 years.”

However, he alleges the company’s sale of discount furniture with added coverage only for accidental damage falls outside of a typical insurance service contract.

“Defendant denies claims based on customer misuse, even where that misuse may have occurred unintentionally, and is unexpected or unforeseen, which is the definition of an accident,” Wong says.

“In reality, Goof Proof does not protect the furniture purchased by Bob’s customers.”

Sofa and chair not covered under insurance

In Wong’s case, he bought a Jaxon sofa/chair combo for $749.00, and Goof Proof for $129.99, at Bob’s Discount Furniture in 2019.

In June 2020, Wong submitted claims for his sofa and chair, because the chair arm became deformed.

Bob’s Discount Furniture denied his claim, saying the damage didn’t happen accidentally, but rather through normal use. 

“Defendant’s denial of the claim on the chair’s arm because it was ‘not classified as

a customer-caused accident’ even though it ‘occurred from a single incident’ ‘during normal use of the item’ disregards that the breakage occurred due to the underlying faulty frame of the chair,” the lawsuit states. 

“To the extent coverage was denied based on damage occurring during ‘normal use’ of the chair, this is equivalent to a wear and tear exclusion.”

Wong is suing on behalf of all California customers who purchased Goof Proof.

He’s suing for breach of warranty, breach of California consumer laws, and for bad faith insurance denial. Wong is seeking certification of the class action, damages, an injunction, fees, costs and a jury trial. 

This is not the first class action lawsuit over this issue. In April, Bob’s Discount Furniture was hit with a class action lawsuit alleging it misled consumers about the quality of a couch with a reclining chair it sold and then failed to honor extended warranty claims when it prematurely broke.

    Goof Proof is absolutely no good I filed a claim and it was denied they tell you it covers everything and when you file it they come up with something else

    You can add me to the growing list of disgruntled ex-patrons. The sales people give the impression that the goof proof covers whatever the mfg warranty does not but for 4 years longer. The truth is that goof proof is a very narrow list of possibilities and the mfg warranty ends in ONE YEAR so they just eventually say everything is a mfg defect. Too bad you bought this pos our sorry mfg built. We know we sell crap but what are you going to do? Ours is a 3 year old loveseat with seam splitting, and material peeling and tearing, none of which is covered under goof proof. Pathetic!

    GUARDIAN SUPPORT IS A FRAUD…..DO NOT GET GOOF PROOF from BOB’s Furniture.
    I’ve been putting a claim in since February for a frame on couch broken. We noticed it and was like the frame is cracked or broken. sent claims in. & they are denying me saying this is normal use. How is broken frame normal use. & I have 2 years still of protection. THIS IS COMPLETE SCAM… if you don’t realize how to fill out the form correctly they deny you & say normal use.

      I have had a similar experience and was also denied coverage from “normal use” even when I pointed out the definition of “non-accodential damage” which does not state normal use! I just want a functional couch and now I just have junk!

    DON’T SHOP AT BOB’S FURNITURE!! The sales people will say anything to get you to purchase the goof proof plan. After spending $349, and telling us NO QUESTIONS ASKED, GUARDIANS find excuses NOT to repair your purchased items AND they walk away with your money. The managers ACT like they’re trying to help, meanwhile the sales person at the West Hills location, ENZA, simply is about the sale. We have an issue of our leather sectional being torn and seeing that Guardians ran from helping, we thought Enza would be kind enough to help with the issue. Instead, she back peddled and simply didn’t want to deal with it. In fact, the last time my sister went to address about another wrongful purchase, ENZA saw my sister and ran the opposite direction instead of approaching and trying to help. DO NOT GO TO THE WEDT HILLS, CA location. Most of all, DO NOT PURCHASE THE GOOF PROOF PROTECTION PLSN UNLESS YOU WANT TO THROW AWAY YOUR MONEY. We felt as though the GOOF PROOF was a scam. The sales person was in it for the money. She didn’t follow up after being reached out to. Avoided our calls. And BOB’S ASDOCIATES/CUSTOMER SERVICE LIED TO US WITH ONE BOGUS EXCUSE AFTER ANOTHER. The sales person through everything on CORPORATE’S FAULT. Taking the easy way out by passing the buck on the ones’s that are paying her salary. How grateful is she.

    I was just denied my claim literally say on the couch and it just caved right in crack. Out of no where. I immediately called and weeks later the deny me saying normal use. And I’m like there is nothing normal about it. And the lady agreed and than said it is most likely a manufacturer defect which is not covered. This is absurd. 399 for what stealing from people. What a scam. I’m so upset. I would like to be added to this list aswell.

    I purchased many items from Bob’s with the goof proof. My claims are always denied. My latest one is the most egregious. The power cord on my power recliner broke. They denied my claim because they said that only motors are covered. I was told goof proof covers everything. How can I use this item the way it’s intended without the power cord? That makes no sense. I’m done with Bob’s.

    Purchased sectional from Bob’s. First, it took months for my furniture to arrive. 2nd, when it did, my recliner was broken. They tried to fix it 2 time before deciding to replace the piece. Waited months for the replacement to come. When it arrived it was a different color grey. Bobs furniture stated it wasnt the wrong color but changes the palette. I explained to them that whatever they want to describe the different couch color as. The fact remained that the sectional was different colors. The refused to do anything about resolving the issues. I also put in a claim for my toddler accidentally writing on the couch with a marker without resolution yet.

    We were adamantly and clearly told the warranty covered ANYTHING that happened over a 10 (TEN) year period. Well today I found out that is wrong and it’s only 5 years. Our issue is with the fabric panels fading. Not a wear issue. Was treated rudely by guardian rep as well as the escalated manager at the deptford NJ store. It’s clear this company doesn’t care if salesman are doing and saying anything to make that sale and up charge.
